Well, hallelujah, it turns out there is one trial lawyer menace to the economy that Tom Daschle draws the line at -- when lawsuits might stand in the way of a tasty piece of home-state pork barrel. This one is rich, in so many ways.

Obviously, tort lawyers can't be allowed to go hungry, so instead of simply shielding the company from liability, Mr. Daschle enacted a law transferring the risk to the federal government (i.e., taxpayers).

Love to a trial lawyer is never having to sue anything other than a deep pocket, and having plenty to sue. And apparently Senator Daschle is in love with the idea of trial lawyers being in love. He would be "deeply disappointed" if they weren't.

If the tort system is so great, let's make criminal law operate the same way. Open ended punishment. Jay walking might carry the death penalty and murder might get you a $25 fine.

Being able to sue is important, however, there should be caps on awards as well as caps on attorney fees. It's too frequently not about real wrongs suffered but only about greed.

There should be a law that if an attorney loses a frivolous lawsuit you can turn around and sue him for harassment and extortion---to the tune of zillons of dollars, or at least an amount equal to what he was seeking. Let them carry harassment insurance like they force the medical field to carry malpractice insurance. (not that the meds don't need a watchful eye, but, much of it is frivolous and has a great deal to do with the ridiculous price of healthcare.)

As much as it pains me to agree with Daschle, the National Underground Laboratory is as worthwhile a physics research project as any currently under consideration.

Of course, I'm under no illusion that Daschle is in the least bit motivated by the physics potential.
