The answer is easy. It's in the Constitution. The courts are used to settle disputes, and, in fact, that was the process on going at the time of the crime. There was no emergency requiring police action, much less the use of deadly force and gestapo tactics.

I do not interpret the constitution as making it necessary for the government to sanction when I, having committed no crime, can retain custody of my child

Now, if there is a question of criminal activity on the part of Elian's father - then the courts are to be called into play. Of course, if the father's crime is his political idealogy - then have we not become Nazi Germany?

...RIGHT ON, Jim Robinson.
...Isn't it interesting how with the clever use of America's TV Networks...
...President CLINTON was able to frame the whole Little ELIAN Case just the way HE wanted it framed...
...as in telling an America where over half our marriages end in divorce...
...that a Son needs to be with his Father and a Father needs to be with his Son...just to satisfy CLINTON's Communist Partner FIDEL CASTRO...?
CLINTON's own true M.O. =
'It's the TV, Stupid, no matter WHO pays for it'
...as CLINTON was able to put a nation to sleep that was on Religious Holiday to make his Attack in Florida ...just like his Partner Communist North Vietnamese did during 1998's TET Religious Holiday in a then Free South Vietnam.
The Enemy is now Within.
