FOX NEWS REPORTS PENDING SHOWDOWN BETWEEN WHITE HOUSE AND MARY FRANCES BERRY

Brit Hume reports that Mary Frances Berry, chairman of the U.S. Civil Rights Commission, is refusing to acknowledge the Bush White House's latest appointment to the U.S. Civil Rights Commission.

Ms. Berry sent a letter to the White House Counsel, Al Gonzales, saying that if they do intend to send the nominee to the meeting tomorrow, they best send along the U.S. Marshalls to seat him, as she will not allow it.

Fox reports that the term of one of the Democrats has expired and President Bush is exercising his right to appoint a member of his choice. The Panel on Hume's show said that this has NEVER been done before; that when someone is appointed to fill a term that hasn't been expired, when the term expires, the person leaves the committe. They also report that the woman who is being removed from the commmittee plans to show up tomorrow with a civil rights attorney and claim that she should get a full six year term, not just complete somebody else's.

Ms. Berry contends that the person leaving the committee was appointed for six years, not just to fulfill the term of a member who either died or left the commission (I can't remember which!)

Civil Rights Commission Information

Organization

The United States Commission on Civil Rights is composed of eight Commissioners: four appointed by the President and four by Congress. Not more than four members shall at any one time be of the same political party.

The President also designates the Chairperson and Vice Chairperson from among the Commission's members with the concurrence of a majority of the Commission's members.

The Commissioners serve 6-year terms. No Senate confirmation is required. The President may remove a member of the Commission only for neglect of duty or malfeasance in office.

Two points here:

1. There are already four DemocRATs on the commission, excluding Berry. She calls herself an "Independent" - the lying bitch. There is only one acknowledged Republican on the commission - Abigail Thernstrom.

2. If she persists, she is surely guilty of neglect of duty AND malfeasance and the President should dump her.

The key to this is explained as follows:

Berry's support of Wilson has a personal dimension. Although she's been on the commission since the 1980s, Berry's current term began when she succeeded Connie Horner, whom the first President Bush had picked for the commission in the final hours of his presidency. Horner's term expired on December 5, 1998 — but President Clinton didn't get around to putting Berry in that slot until January 26, 1999. The White House clerk's office, staffed by career bureaucrats, insists that Berry's term ends in December 2004. Berry, however, says it concludes on January 26, 2005 — just a few days after the end of President George W. Bush's term.

From what I overheard on Fox as I was freeping. Someone appointed during the clinton era died, someone was appointed to finish out that persons term. It expired in November. Bush is executing his right to appoint someone now.

Berry thinks the person filling in for the dead person should get a full six year term and is fighting it. Everyone else believes the person replacing the dead person should have only stayed on until the dead person's term was up, which was November.

She wants this and she wants to create a circus atmosphere. Can you imagine the publcity she will get if armed U.S. Marshalls show up to force the seating and unseating. Reminder of the 60's.

How are commissions formed? By the President or by Congress? Could President Bush simply "dis-enfranchise" the whole Commission? That would be beautiful!!!

The person who's supposed to leave was appointed to serve out the term of another appointee who died. That term ended this month.

Now Berry and this other woman are arguing that she should have gotten to serve herself for a complete term, not only to fill out the remainder of her predecessors term.

Another example of liberals wanting to change the rules after the game has been played.

The whole thing is horses___!

They should just disband the whole damned Civil Rights Commission joke. It's nothing but a "quota congress" anyway.

This is the same "Commission" that found (with no corroborating evidence or testimony) that the Bush brothers conspired to steal the Florida election and deliberately sought to disenfranchise minority voters.

They found plenty of "witnesses who testified that they had problems at their polling place but not one person, who was legally entitled to vote, testified that they ultimately were kept from voting.

The majority Democrats, led by that fraud Berry, refused even to allow the minority Republican members to include their dissenting opinions in the final report.

This is breathtaking if you think about it......

This woman is telling the President of the United States to take a hike tomorrow .......and expects the White House to go along with her demands....

Bush is in the process of dismembering the Taliban and Al-Qaeda.......and she really thinks he will cave to her .....
