He's basing his authority for this on the joint resolution which Congress handed over in lieu of a declaration of war. An order such as this is perfectly legal with a declaration of war in place. Without one, it isn't legal but no challenge is going to be entertained by the Supreme Court, you can bet.

If those who defend everything done by their own partisans in government would just realize that these things can be handled better by adhering to the Constitution, they wouldn't be put in the position of defending illegal actions by their politicians. Bush could have had a declaration of war at anytime since 9/11 by asking for one. Why he didn't ask is a mystery to me.

Am I correct in assuming that this would explain all of the suspects currently detained that are being held without bail? These suspects would not be helped by any ACLU action with this order in place would they?

I agree that a declaration of war would be far preferable, and definitely more CONSTITUTIONAL than the current situation. Why Congress hasn't declared war, with or without a request from the President, is a mystery to me.

My only explanation is that most of the members of Congress have appeared for some time to be WEENIES.

Because of congressional Democrats. They muck things up enough as it is. Can't you hear them around election time or when there is a bump in the road? "I voted yes on the declaration of war but I NEVER was told this and blah..blah..blah"

Shame on you. Name calling seems to be "du Jour" on this forum recently. I'm must be one also, because this is not a "war", it's a "police action" and will remain so until congress OFFICIALLY declares war AND fully defines the enemy which has to include iraq. Fat chance of it happening.

I think that you can thank the "trial lawyers" for that. Do you realize how many "war clauses" there are in insurance policies? If war was declared, the trial lawyers would have a field day.

I think it's worth asking...most of congress is made of lawyers...just WHO do you name as the belligerent in this kind of declaration of war...it's a real sticky wicket, that one. I sense this is the reason why we didn't...but even so, it's worth asking one of the top boys of the administration on one of these screaming face Sunday shows...
