Unfortunately, you should never speak with an LEO working in his official capacity without the presence of an attorney.
What if the LEO never notified someone that he was an LEO and appeared in plainsclothes, allowing no determination to be made as to their position or official capacity?
Wouldn't that be wrong too?

A large percentage of LEOs consider themselves to be above the law.

My sympathies if that happened to you.
