Virginia voters approved a constitutional amendment Tuesday that embeds a fundamental right to kill babies in abortions up to birth in the state constitution.
With 52.83 percent of precincts reporting, the Associated Press showed “Yes” leading 60.09 percent to 39.91 percent on Question 1. Other early tallies showed a similar margin.
Pre-election models had given the measure better than a 98 percent chance of passage. The pro-abortion side reportedly spent as much as $5 million buy the vote and run ads lying to voters about what the amendment would do.
The amendment establishes that every individual has the fundamental right to so-called reproductive freedom, including abortion. The Commonwealth may regulate abortion in the third trimester, but the amendment allows abortionists to decide that killing babies in late-term abortions is somehow necessary.
Olivia Gans Turner, executive director of the Virginia Society for Human Life, called the amendment “the most insidious threat to our right to pass the laws needed to protect women and their children.”
She said it is “dressed up as a legitimate measure in innocuous language that hides the full effect of adding this amendment to our State Constitution.”
“The hard truth is that this amendment is not about protecting women’s safe reproductive care, but merely more political action designed to make abortion up to birth permanently legal in Virginia,” Turner said. “The amendment isn’t about prenatal care, miscarriage care or fertility care, it’s about allowing unlimited abortion up to birth.”
Critics said the mental-health exception and viability standard would permit abortions throughout the third trimester for virtually any reason.
Former Del. Robert Marshall and attorney Josh Hetzler argued the measure would also eliminate parental consent requirements for minors seeking abortion, birth control, sterilization or transgender medical interventions. Hetzler said that among other consequences, it will eliminate statutory rape laws for consenting minors.
Turner added that the wording “is written to deliberately deceive the public.”
Under existing Virginia law, abortion is generally available through the second trimester, with tighter restrictions after about 27 weeks. The amendment, which requires only a simple majority, takes effect without further action by the General Assembly or governor.
A legal challenge seeking to block certification is scheduled for a hearing Nov. 13.

Putting amendments out for general votes with a simple majority to succeed is a scam.
If it takes a super majority for a congress to pass an amendment, it should take the same super majority when everyone votes.

The amendment does more than just lock in abortion up to birth in the constitution. It removes all authority that parents have over their minor children in regard to abortion or birth control and shields anyone who provides abortion or birth control to minors. It is absolutely evil.
