udge dismisses case against ex-FBI agents accused on lying to Congress in Hunter Biden investigation

A judge on Monday dismissed a criminal complaint against a pair of former FBI officials accused of lying to Congress about what they knew about the Hunter Biden investigation, a person familiar with the matter confirmed to NBC News.

U.S. Magistrate Judge Zia Faruqui found the government had failed to show probable cause that Nikki Floris and Bradley Benavides had lied to Congress about Hunter Biden’s laptop.

The case was brought by criminal complaint rather than being presented to a federal grand jury in Washington, where jurors have been skeptical of politically-tinged cases against purported Trump enemies, most recently rejecting the attempted indictment of Cassidy Hutchinson.

The complaint alleged that the duo lied about their roles on the Foreign Influence Task Force and “about their roles in the FBI’s Hunter Biden investigations” while testifying before the House Judiciary Committee in 2023.

The dismissal came after an FBI agent testified at a preliminary hearing last week that he was concerned the investigation, which had been directed by FBI Director Kash Patel, would be viewed as “political.” He also acknowledged a prosecutor on the case had acknowledged the criminal complaint was flawed in a telephone call last week.

I found out how dangerous it is to comment on judicial proceedings yesterday, as it brings out all sorts of persons styling themselves ultra- constitutionalii[sic]sts, so I'm really just commenting on the usual press behavior of naming the prosecutor's partisan Republican background, while noting the absence of the judge's appointing administration. It's always there for "Trump judge."

On May 4, 2026, Judge Zia Faruqui questioned the D.C. Department of Corrections on the conditions under which Cole Tomas Allen, the man charged with trying to kill President Donald Trump (R) and his cabinet members at the annual White House Correspondents’ Dinner on April 25, 2026, was placed on suicide watch.[5] Allen’s attorneys said he was placed on suicide watch without a complete psychiatric evaluation, had been held in isolation for up to 23 hours a day, and was not afforded basic privileges including visits, nonlegal phone calls, and access to a Bible. Allen was removed from the city jail’s suicide watch status prior to the hearing, and Faruqui ordered the department to report back the following day with any determinations or updates regarding Allen’s holding.[5][6] “I’m obviously very concerned about how we’ve gotten here,” Faruqui said. “He’s been treated completely differently than anyone I’ve ever seen.”[5]

On May 5, 2026, the general counsel for the Department of Corrections reported that they provided Allen with a Bible and notified the judge that a final holding determination would be made on May 6, 2026.[7]

Much as I’d like to see different outcomes on a number of these cases, it seems there is often plenty of blame to go around. There is no room for sloppy prosecution or mistakes, as it will be an uphill battle regardless.

This judge basically green-lit politically-motivated crimes.

If an FBI agent perjures himself to cover up a crime against a candidate, prosecuting that person is deemed to also be politically motivated which then disqualifies the prosecution of the original crime?

We know how this story goes... Democrats invent new lows, and Republicans are powerless to prosecute.

If Watergate happened today, the judges would dismiss the charges against the burlars, if they were Democrats.

They're not accused of lying to Congress, they lied to Congress.

It their names were Bannon or Stone, they’d have an army division in the front yard and an armada coming up the canal in the back.

The case didn’t go to a jury because the DOJ thought they’d have a better chance in front of a DC Judge.

The jokes write themselves.

His biography from the United States District Court: Court of the District of Columbia

Magistrate Judge Zia M. Faruqui

Zia M. Faruqui was appointed as a United States Magistrate Judge on September 14, 2020. He received a B.A. and J.D. from Georgetown University. Following law school, he was a litigation associate at Willkie Farr in Washington, D.C., where he focused on government investigations and general commercial litigation. Judge Faruqui then served for twelve years as a federal prosecutor in the U.S. Attorney’s Offices in St. Louis and Washington D.C. While there, he prosecuted cases involving terrorists use of cryptocurrency, North Korean weapons proliferation, darknet sites dedicated to child exploitation, and the theft of antiquities. He also represented the Department of Justice at numerous conferences across the globe on financial crimes, cryptocurrency, and national security issues.

Who was President on September 14, 2020?

There is no chance of holding ANY Democrat accountable for political crimes in liberal district courts.

So Republicans getting bent out of shape due to lack of prosecutions need to recognize the limitations of the legal system.

Between the nearly 100% conviction rate of the January 6th defendants and the extreme pushback against prosecuting anti-Trump wrongdoings, the legal community has made it clear that a two-tiered system of justice now exists.

Actually, federal magistrate "judges" are creatures of the chief judge of the particular district court at the time of appointment.

The chief judge at the time was Beryl Howell, a notorious Trump hater.

Irrelevant! Magistrate judges are appointed by District judges, not by Presidents. In this case it's the DC judicial mafia cesso [it. = toilet] enlarging its own pool.

>the DC jury

Is this an inevitable problem arising from the 6th, or is it the result of statues and decisions warping the 6th into giving DC juries immense powers over the rest of the citizenry. 6th says:

…by an impartial jury of the state and district wherein the crime shall have been committed, which district shall have been previously ascertained by law…
I don't claim to be a lawyer, much less a 6th amendment scholar, but it seems to me that much of the crimes against Federal laws, rules and regulations could be ascertained as taking place in many, even any, part of the country, not limited to the seat of government. And that neither the responsibility and nor the power of jury oversight of all such crimes should be limited to those few citizens residing within that maximally 10 sq mile seat. Indeed there have been proposals to shrink DC, reverting most of its residual residential areas to MD, as its onetime VA side was reverted years ago. Latter history, de facto - de jure remains periodically argued - shows that is possible, but would make the 23rd undeserved for so few remaining residents and and would practically draft those few as professional jurors given the wealth of cases currently ascertained as 'taking place' within DC. Better to reascertain where much these cases take place as within the whole Federal physical body.

OK ... so according to wikihahahahapedia: She [judge Beryl Howell] was appointed to the District of Columbia federal court in 2010 by President Barack Obama, and she served as its chief judge from 2016 to 2023.

So if you pull the thread, the relevant President was Barack Hussein Soetoro Odinga Whatever Obama.

Now it makes sense.
