A state judge overseeing the lawsuit from a Cornell student who alleges she was raped by several members of a fraternity at a party in 2024 will consider arguments on Thursday from the attorney of one of the men accused who wants to see New York Attorney General Letitia James removed from the case.

Andrew Miltenberg, an attorney for one of the accused, is asking Judge James R. Farrell to order New York Gov. Kathy Hochul to appoint a special prosecutor “who is free from actual or perceived conflicts of interest or bias," the Associated Press reported.

Earlier this month, Hochul took the case away from a local prosecutor who declined to bring criminal charges in 2024 and handed it to James as a special prosecutor. After being appointed to the case, James posted on X and Facebook comments that Miltenberg says reveal she is biased.

A quick look at some of the judge's decisions found here would seem to indicate that he isn't a leftbot, and will judge fairly.

The only position in a court that she is qualified for is that of “defendant”.

Why is a prosecutor involved with a lawsuit? Is the government a party to the civil action or is the lawsuit judge connected to the potential criminal case as well?

I used to wonder how it was done but then saw a news clip of how moose are moved to another state where they have a better chance of survival in the woods there.

It was a thick harness holding the moose under a helicopter that set them down later. 🚁🫎

Let’s remove Laetitia that way.

Wow. Amazing. 🥇

Now with a heavy lift miliary helicopter maybe we can get Sen. Elissa Slotkin out of Michigan.

“Heavy lift helicopter capacity depends on engine power, rotor performance, maximum gross weight, cargo-hook limits, aircraft configuration, environmental conditions, fuel requirements, and operating safety margins.”

You seem to have civil and criminal trials confused. This is a criminal trial with an accusor. James is the state prosecutor.

You seem to be making a joke?

This is a state trial, not federal, and Boasberg is not involved.

Then why does the article indicate it is the judge overseeing the lawsuit that is hearing arguments about Big Tish. I have a feeling it is just a poorly written article and the judge in question has nothing to do with the civil suit but you never know when a particular state has a quirky law or legal structure.

There are going to be two trials, the civil suit, and maybe a series of criminal trials if they actually prosecute the case.

Sorry, should have added a sarc tag to my post. Yes, was making a joke.
It seems Boasberg’s name keeps popping up in every trial of significance, lately.
