Virginians are being asked to write abortion into the Bill of Rights of their state constitution. The amendment's mild-sounding language hides a sweeping legal standard that would put existing protections for preborn children and their mothers at risk.
The so-called Right to Reproductive Freedom Amendment will appear as Ballot Question 1 on the November 3 ballot. The General Assembly approved it twice, in 2025 and again in January 2026, and Gov. Abigail Spanberger signed the legislation sending it to voters in February. If it passes, it takes effect January 1, 2027.
Key Takeaways:
* The Virginia ballot amendment would group abortion in with things like prenatal care and childbirth, which are already legal and widely available. But cementing the killing of preborn children as a "right" is the true intention of the measure.
* The amendment would give those who commit abortions, like doctors and nurses, immunity from punishment and would allow third trimester abortions for vague reasons of "health" including mental health.
* Placing abortion in the state's Bill of Rights would sharply limit the people's ability, through their elected representatives, to ever protect children in the womb.
The Details:
What the amendment would do
The amendment would create a "fundamental right to reproductive freedom" covering decisions about prenatal care, childbirth, postpartum care, contraception, abortion, miscarriage management, and fertility care.
Abortion is the heart of the measure; the other items are already legal and widely available in Virginia.
The key provisions:
A strict legal test. The state could not "directly or indirectly" burden this right unless it proves a compelling interest pursued by the least restrictive means. That is the most demanding standard in constitutional law, and it is a gift to abortion industry lawyers looking to challenge any regulation.
Immunity from punishment. The amendment protects patients and the doctors and nurses who commit abortions from being punished for those decisions.
A third-trimester loophole. The state could restrict abortion in the third trimester, except when the mother's life or physical or mental health is at risk, or when the pregnancy cannot survive. A "mental health" exception, as written, can be used to justify late-term abortions for nearly any reason.
"It doesn't change anything"? Then why put it in the constitution?
Supporters insist the amendment would not expand abortion beyond current Virginia law. But campaign promises are not constitutional text. Once the amendment is ratified, courts, not voters and not legislators, will decide what "indirectly burden" means and which existing laws survive.
Virginia is already the only state in the South that does not protect preborn children at or before 12 weeks, with abortion legal through the second trimester. This amendment would make that status quo nearly impossible to change and would put remaining safeguards, such as facility standards and limits on late-term abortion, in the crosshairs of litigation. In other states that passed similar amendments, abortion businesses went to court almost immediately to dismantle pro-life laws.
A constitutional right, not just a law
The central issue is not merely whether abortion stays legal in Virginia. It is whether ending the life of a preborn child becomes a constitutional right on par with freedom of speech and religion. Placing abortion in the Bill of Rights would sharply limit the people's ability, through their elected representatives, to ever protect children in the womb.
A child in the womb is a living human being from the moment of fertilization. A constitution should protect her, not guarantee the right to end her life.
The Bottom Line:
Vote NO on Ballot Question 1. A NO vote rejects the proposed constitutional amendment and keeps abortion out of Virginia's Bill of Rights. Early in-person voting is underway and runs through October 31. Election Day is Tuesday, November 3, 2026.

I live in VA. it is lost. Maybe 3 or 4 people will vote against it.
No prolife Christians pushing to vote No in Virginia?
Of course. But have you seen how Virginia votes lately? Our AG fantasized about murdering infants of conservative parents and STILL won his election.
I forgot about that. Point taken.
Still call everyone you know, at least try.
I’m one state over from you. They can’t get abortions here so they are going to your state. If this passes it will be worse.
I also live in Virginia and will vote “NO”. The more I hear from the democrats, the more I am convinced they are the party of satan and evil. What could be more demonic than killing an innocent child in the womb?
Female libs are the loudest calling Gaza a genocide but Gaza has had abt 40,000 deaths since the war started (i KNOW AWFUL - BUT THAT IS A WAR THEY STARTED). The actual greatest genocide in history is from these same female libs killing almost 500,000 PEOPLE a year, according to PP.
Maybe some of those now aborted PEOPLE could have solved many of our world’s problems. We will never know how much better our world might have been. We DO know these female libs hate with the same veracity with which they kill their own. Even after they are born they kill them.
Ever wonder if Clancy’s mom now wants to abort her. After all she is disabled and worthless right?
FWIW the AG race was stolen. This prop will pass. What a gift ending RvW was to the rats. They can just keep putting abortion props on November ballots and an army of selfish single issue women will come out and vote straight dem every time.
I guess not, sadly.
You are correct. VA is lost.
Yes. The VA GOPe is running the same (non) campaign that they have since we moved here nearly 20 years ago. I think if they ran a serious get-out-the-vote campaign, Virginia would have a chance of saving itself, but the GOPe is more interested in back-slapping, country club parties than winning seats.
