SCOTUS agrees to hear challenge to ICE's mass detention policy

The Supreme Court on Thursday agreed to hear a challenge to Immigration and Customs Enforcement's (ICE) mass detention policy, Politico reported.

The policy has faced several defeats in lower courts amid President Donald Trump's mass deportation efforts. At least one federal appeals court, the Fifth Circuit, has backed the administration, while others have struck it down, creating what is known as a "circuit split."

The Supreme Court typically, though not invariably, waits for such a development to hear major cases.

The correct case is RHONEY, ACTING DIR. V. BARBOSA DA CUNHA, RICARDO A.

The Missionaries case (also granted cert today) issue is:

“Whether a land-use regulation that prohibits a religious institution from building a religious structure on its own property constitutes a “substantial burden” on religious exercise under the Substantial Burden Provision of the Religious Land Use and Institutionalized Persons Act.”

When did Americans decide to put Feral SCOTUS judgie Jugheads in charge of stopping the illegal alien invasion of America? Those SLOBs aren’t the military. They also opened the flood gates on deportations - so we shouldn’t need mass detention once we catch up.

SCOTUS has ruled for the Executive Branch in majority if not all cases on immigration. We mass detain a lot of people not sure why this is an issue? Illegals want to be paroled so they can disappear, steal name. SSN and hide in plain sight. Friend told me ICE uses a very high tech facial ID program. But, they generally only catch illegal aliens using facial ID if they are arresting someone else.

SCOTUS has been pretty good at upholding Trump’s immigration policies - but I don’t trust anything from them any longer, they are all over the place on a lot of issues, including birthright citizenship.

Wins:

“DHS Database Overhaul: The Court allowed the use of an expanded citizenship verification system (SAVE) for voter roll checks ahead of the 2026 midterms.

Asylum Restrictions: The Court cleared the way to revive ‘metering,’ a policy limiting the daily number of asylum seekers processed at the U.S.-Mexico border.

Temporary Protections: The Court permitted the termination of Temporary Protected Status (TPS) for migrants from Haiti and Syria.

Green Card Enforcement: The Court ruled that border agents do not need ‘clear and convincing evidence’ of a crime to refuse re-entry to lawful permanent residents returning from abroad.

The U.S. Supreme Court ruled 6-3 on Tuesday, September 29, 2026, to temporarily allow the Trump administration to resume ‘third-country’ deportations while the Court prepares to hear full oral arguments on the policy’s legality in December.”

The problem seems clear. To be in the US is a PRIVILEGE, not a RIGHT. To Deport is to remove the PRIVILEGE. To put in a Detention Center raises issues of RIGHTS.

Reduce Detention Centers. Remove the PRIVILEGE. Do not touch RIHTS.

That case pertains to land use. The case regarding illegal immigration is Rhoney v. Barbosa da Cunha.

What needed to be done was deporting all these illegals as fast as possible as quick as possible without a care for the courts. That is exactly what Biden did letting them in and that would be the only way for getting them out. Do what you’re gonna do and deal with the consequences later. Trying to right this illegal wrong LEGALLY is just a huge waste of time. It’s not gonna happen. Unfortunately our chance to right this wrong has come and gone.
