The US Labor Department has suspended Cognizant Technology Solutions Corp.’s ability to file new applications for permanent labour certification, adding to scrutiny of the Indian IT services company’s use of US employment-visa programmes.
The suspension will prevent Cognizant from making fresh PERM filings until the department completes an investigation into alleged fraud involving the company’s H-1B and PERM programmes, the department said.
The probe follows complaints from whistleblowers alleging wrongdoing in Cognizant’s use of the immigration programmes. Cognizant did not immediately respond to a request for comment.
The department’s inspector general, Anthony D’Esposito, said on X that the agency was working with the White House Fraud Task Force to examine the allegations.
What is PERM and why does it matter?
PERM, short for Program Electronic Review Management, is the US process through which employers seek certification that allows them to hire foreign workers for permanent jobs in the country.
Before seeking employment-based permanent residency for a foreign worker in most cases, an employer must first obtain certification from the Labor Department. The process requires the employer to demonstrate that there are no qualified US workers available for the position and that hiring a foreign worker will not adversely affect the wages or working conditions of US workers.

Funny how these groups like Cognizant and Deloitte come up in the news and I think, yah that doesn’t surprise me. Worked with people from several of these vendors. Almost all our vendor teams from these groups were almost exclusively H1Bs. You’d get a few that were pretty amazing and a value to have. The rest, clearly were not providing skills that US citizens didn’t have.
DHS has no system or enforcement mechanism to track if and when any H-1B or guest workers leave after their visa expires. They are all defacto new American citizens. Who take an American job and vote for democrats. Millions of them. It is insanity...
Agreed, this is long overdue.
All these H1B shops are complete frauds. Especially when we have 1000s of unemployed CompSci grads and even more laid off tech workers in their 50s and 60s.
Cognizant should be shut down.
This is an excellent development. We need more of this.
The H1B is ‘dual intent.’ One can come here on an H1B and then convert to a ‘green card.’ I recently had a conversation with an immigration attorney and asked how many convert to ‘green card.’ He said ‘virtually all.’
In all my years in tech, I can only recall one outstanding H1B. This was in the late 1990s and he was from Romania.

There are several people on X who are tracking the H1B hires of companies and reporting the abusers to the appropriate federal agency. They are finding the evidence and building the case so the agency has very little to do to move forward with the claims.
Cognizant is not small potatoes.
They are the sixth largest filer of petitions for foreign labor.
Only Amazon, Google, Microsoft, EY & Deloitte are larger.
I never claimed they were.
