Homeowner shoots and kills suspect trying to break into Avery St. home: RPD

ROCHESTER, N.Y. (WROC) — A Rochester homeowner shot and killed an intruder who police say was trying to break into his Avery Street home early Monday morning.

Rochester police responded around 4:15 a.m. to the 300 block of Avery Street near Emerson Street.

RPD Capt. Frank Umbrino said the homeowner was awakened by someone attempting to enter through the back door. When officers arrived, they were met by the homeowner and found the suspected intruder inside the kitchen.

The intruder was pronounced dead at the scene.

“It appears at this point that it’s a justified shooting,” Umbrino said.

Police said the homeowner has a valid New York state pistol permit and that the handgun used in the shooting was legally owned and registered. He is fully cooperating with investigators.

Investigators said the home had been burglarized at least twice since June. Police said the man who was killed was not known to the homeowner and was on parole for a previous burglary conviction. He was also known to law enforcement.

His identity is being withheld pending confirmation and notification of his next of kin.

Next-door neighbor Thadeus Williams said he was asleep on his couch when the sound of gunfire suddenly woke him.

“All I hear is ‘fah, fah, fah.’ I’m thinking I got hit because I’m dreaming,” Williams said.

Williams said he had not previously experienced anything similar on Avery Street, but the shooting has made him more aware of what could happen close to home.

“I definitely raised my antennas, and now I’m definitely on 10 about everything now,” Williams said. “My father always said, ‘Don’t open the door if someone was knocking at 3:00 a.m.’”

No criminal charges have been filed.

Police said the investigation remains ongoing and all evidence will be submitted to the Monroe County District Attorney’s Office for review.

I think they should still charge the dead perp with the crime, have some kind of cursory court hearing where he is declared “guilty” and then sentence him to death.

Unless the homeowner dragged the perp inside, the intruder HAD BROKEN IN, he wasn’t trying!

The outcome of this incident doesn’t help the NYS anti 2A agenda.
It would’ve been so much cleaner had the villain killed the home owner and then absconded into the night with the dead man’s blue ray collection never to be seen again.
