Federal judge bars Trump from implementing proof of citizenship requirement to vote

A federal judge on Wednesday permanently barred President Donald Trump’s administration from implementing most of his first executive order on elections, part of which sought to require people to show documentary proof of citizenship when they register to vote.

The ruling by U.S. District Court Judge Denise Casper in Boston effectively converts a preliminary injunction she issued a year ago, in which she temporarily blocked many of Trump’s efforts to overhaul elections, into a permanent ban. Casper rejected the administration’s argument that the lawsuit to block the changes brought by Democratic state attorneys general was premature because the rules had yet to be implemented. Instead, she agreed that the Constitution gives states and Congress the authority to regulate elections, and that Trump’s requirements violated the separation of powers.

However, she issued a nationwide injunction from her district bench. Trump isn’t the only one violating boundaries.

Maybe. But then, can she issue a ruling which ALL THE STATES have to follow?

If the Save American Act passes, can her decision overrule/supersede that act?

For once, a judge is correct. Elections are up to the states. If Congress wants to pass something than they can. A President does not run elections.

Tangentially, issues over counting ballots in Federal elections received after election day should be resolved when Watson v. Republican National Committee is decided next week.

Congress is not going to pass the SAVE Act.

An executive order can’t affect election laws, which are set by the states for the states. The judge’s ruling was meaningless.

No! Why? Because the Constitution specifically delegates to the states the authority regulate the time, place, and manner of federal elections, unless overruled by Congress (U.S. Constitution, Art. 1, § 4; Art. 2, § 1) If the Save America Act passes, then that replaces state laws that conflict with the Act.

100% correct.

Hmmm....I think the President is the chief law enforcement officer and election fraud, with illegal aliens brought in by democrats and given drivers licenses (and automatic voter registration through Motor Voter) make it very clear why they pulled this stunt. This is so clearly a tactic to stop detection of crime by refusing voter roll scrubbing to remove registered illegal aliens and dead voters, and verification of voter identity, that the ruling its self should be a crime.

The Constitution is not a suicide pact.

On one hand Democrats claim that their voters are smarter and better informed than Republican voters.

On the other, they claim that their voters are too stupid to know how to obtain IDs in order to vote.

Article I section 4 delegates to Congress the authority to override State election laws regarding election of Representatives and Senators, ONLY.

It most especially does not grant Congress the power to regulate, or even oversee, the appointment of Electors for President and Vice President by the State Legislatures.

The constitution grants the president the power to enforce federal law. It’s illegal for non citizens to vote in federal election elections.

Add to that the constitution guarantees its citizens a federal form of government. Corrupt elections do not make a federal form of government. Corrupt elections make a kleptocracy.

This court decision should be used by Trump as final leverage to get the SAVE ACT passed. Nothing else on his desk gets signed unless vetoed until it is placed in front of him, unspoiled.
