The Supreme Court will be releasing Opinions from the October 2025 this morning at 10:00.
Scotusblog will be liveblogging the release and we will be following along.
There are 26 decisions pending for this term and we expect all opinions will be released by June 30th. You can find a list of the cases at October 2025 cases. Note: The word "held" after the case name indicates the Opinion has already been released. The word "Issues" indicates the questions to be resolved by the Court.
You can find the Opinions on this term's previously decided cases at October 2025 Opinions. Today's opinions will be uploaded just after the case is announced from the bench.
There are several big cases on which we are awaiting decisions.
Little v Hecox
Whether laws that seek to protect women's and girls' sports by limiting participation to women and girls based on sex violate the equal protection clause of the 14th Amendment.
Watson v RNC
Whether the federal election-day statutes, 2 U.S.C. § 7, 2 U.S.C. § 1, and 3 U.S.C. § 1, preempt a state law that allows ballots that are cast by federal election day to be received by election officials after that day.

Whether Executive Order No. 14,160 complies on its face with the citizenship clause of the 14th Amendment and with 8 U.S.C. § 1401(a), which codifies that clause.
Blanche v Lao
Whether, to remove a lawful permanent resident who committed an offense listed in Section 1182(a)(2) and was subsequently paroled into the United States, the government must prove that it possessed clear and convincing evidence of the offense at the time of the lawful permanent resident's last reentry into the United States.
Mullin v Doe
Whether the Trump administration can end the Temporary Protected Status program for Syrian nationals.
And several more. Let's see what we get today!
SCOTUS ping!
IIRC June is the month when they hand down their big decisions.
IIRC June is the month when they hand down their big decisions.
That’s correct. The term normally ends on the last day of June although there have been a couple occasions where it extended into the first week of July. The justices have their summer vacations all planned and get the heck out of DC at the beginning of July.
Gosh, today’s the day when a bunch of ninnies prancing in robes get to tell us that no, you don’t have a nation, and you don’t get to pick who your “fellow citizens” will be, that is a privilege left up to the wants of any foreign invader!
We have the first opinion.
Justice Jackson has the first decision, in Hikma Pharmaceuticals v. Amarin Pharma. It is unanimous.
The court reverses the Federal Circuit’s decision and remands.
https://www.supremecourt.gov/opinions/25pdf/24-889_5i36.pdf
Issue Area
(1) Whether, when a generic drug label fully carves out a patented use, allegations that the generic drugmaker calls its product a “generic version” and cites public information about the branded drug (e.g., sales) are enough to plead induced infringement of the patented use; and (2) whether a complaint states a claim for induced infringement of a patented method if it does not allege any instruction or other statement by the defendant that encourages, or even mentions, the patented use. CVSG: 12/05/2025
The court holds that Amarin, a drug maker, has failed to state a claim for active infringement of its patent.
Hopefully, that’s the last we will hear from Jackson today.
Justice Gorsuch has the next opinion. It is Sripetch v. SEC. It is unanimous, with a concurring opinion from Thomas.
Issue Area
Whether the SEC may seek equitable disgorgement under 15 U.S.C. 78u(d)(5) and (d)(7) without showing investors suffered pecuniary harm.
https://www.supremecourt.gov/opinions/25pdf/25-466_5i26.pdf
This is a case about whether, to get a court order directing violators of securities laws to disgorge their gains to wronged investors, the SEC must prove that victims of the violation have suffered a monetary loss.
The court says “no”.
This means we will not hear anymore cases from Jackson nor one from Barrett, or Kavanagh today.
Justices announce Opinions in reverse order of seniority.
The final decision is FCC v. AT&T. It is by the chief justice.
The vote is 8-1. Thomas has a dissenting opinion

Well, a very unexciting opinion release day. These cases are important to someone, but probably not many here at FR.
But, we are closing in on the most important cases. Down to 23 to go I believe.
This was a challenge to the FCC’s enforcement structure, under which the FCC issues a forfeiture order without the carrier having the right to a jury trial. The court holds that the structure does not violate the Seventh Amendment to the Constitution because the forfeiture order does not definitively resolve the parties’ legal obligations and the FCC’s factual findings are not conclusive.
Thank you. You do a great service to FR
Very wise to have justice Jackson write an opinion for a unanimous decision.
Thank you! I think it is good to have a “repository” at FR for court opinions. It makes it easier to look back for the opinion when you’re thinking “I just know I saw that”.
I think Justice Jackson has basically been regulated to the corner. The other justices occasionally give her a paint-by-number set to prepare an opinion of which they approve.
No more in-state tuition benefits for illegal aliens in Nebraska.
Yes, thank you. It’s nice to have someone conversant in the law write these up. I normally want to read all these myself but you do a good job with accurate summaries.
Thanks. But most of the time, I commandeer the work of those at scotusblog and others.
We will have another opinion release day next Thursday. They might schedule one for Tues or Wed as well. Time is running short.
