Here is Abbott v. League of United Latin American Citizens decided on December 12, 2025, the stay from December. The order is only 3 pages long if you want to read it. Kagan’s dissent is the other 17 pages.

Rat appointments are 100% political weapons. If Ca had done the exact same thing as Texas all 3 would have been fine with it. Their rulings are set before one word of testimony is heard. They spend all of their time finding justification for their “decisions”.

The dissent, of course, wants to claim the majority ignored the facts, while the majority appeals mainly to the law: if the districts were racially gerrymandered, the petitioners (and perhaps the Circuit court) had the legal burden of drawing up a non-racially gerrymandered map that produced similar partisan advantages.

They failed to do so or were unable to do so, leading the majority to conclude the map was based on partisanship and not race.

Texas and Virginia’s redistricting is like comparing apples to oranges. Virginia violated several articles of their state’s Constitution and their own rules with their redistricting process. I think the reversal by the circuit court judge will stand...eventually.

You’re welcome. I wasn’t expecting this from today’s orders, that’s for sure. Order days are usually of little interest.

BTW, we do have an Opinion day coming up Wednesday where we might get the Louisiana voting map case.

It actually helps the dems as the Sup Ct said the courts should not be medling in decisons made close to the elections.
