How Trump’s order on mail ballots threatens Postal Service independence (Barf Alert)

Trump’s order directs the postmaster general, who acts as the Postal Service’s CEO, to set out rules that would require states to notify the Postal Service if they intend to send ballots through the mail during federal elections. States that want to use the mail would be required to provide lists of mail voters to the Postal Service, which would be prohibited from delivering ballots to individuals not on a list.

“Election integrity has always been a top priority for President Trump, and the American people sent him back to the White House because they overwhelmingly supported his commonsense election integrity agenda,” White House spokesperson Abigail Jackson said in a statement.

“The President will do everything in his power to lawfully defend the safety and security of American elections and to ensure that only American citizens are voting in them.”

The order on mail ballots faces at least five lawsuits. The Democratic National Committee, top Democrats in Congress and Democratic state officials have all sued. The legal challenges emphasize the Postal Service’s independence in federal law.

The lawsuit filed by the DNC, top Democratic lawmakers and other Democratic campaign groups, asserts the Postal Service is structured to operate independently of partisan politics. The complaint calls the Postal Service “indispensable” to voting by mail, noting that it delivered more than 222 million pieces of ballot mail in 2024, including nearly 100 million general election ballots.

A dozen Republican state attorneys general filed motions in court this week seeking to defend the executive order from the Democratic legal challenges. The motions call the order an example of cooperative federalism to provide states with optional resources to help protect their elections.

The GOP officials argue the Democrats lack standing to challenge the Postal Service provisions of the order.

The states involved in the Republican-led defense of the order include Alabama, Florida, Indiana, Kansas, Louisiana, Missouri, Montana, Nebraska, Oklahoma, South Carolina, South Dakota and Texas.

The Congress has a near single digit approval but because they’re shameless they are on a pedestal

Come on, did you not read the appendix to the Constitution! The independent PO was right before the one that said the government was responsible for ensuring cradle to grave health care, food, housing, and financial assistance. Otherwise, who would deliver the checks!

I’m sure some judge will overlook this little tidbit and determine it falls under the judicial branch like everything else.

If the USPS is going to be used in the chain of custody for ballots, some limitations and safeguards must be in place.

Biden “won” in 2020 with mail-in ballots and the recent gerrymandering referendum in Virginia passed only because of mail-in ballots—if that stands it may make the difference in November 2026 and hand the House over to the Democrats. They need mail-in ballots.

Covid was in 2020, there is NO reason to have anyone send in their ballot by mail..you go to your polling place and VOTE, period, like it used to be..the ONLY reason why the left loves mail in voting is because of fraud, illegal aliens vote, their dogs, cats, sheep, dead grandparents, sock puppets, everyone votes and they hold onto it til they know how many votes they are losing by and stuff the ballot box

The states can do whatever they want for state office elections, but federal election statute defines and Election DAY for federal offices. The states are violating those statutes by commingling the federal ballots with the state ballots and then holding the federal electins to the state election timelines.

That's the constitutional violation.

Here is the case that needs to be brought to the Supreme Court to put an end to the massive corruption by county election officials (previously posted here).

Split off the federal ballots from the state ballots.

Make the states follow federal statutes regarding the time of federal elections.

Article I Section 4:

The Times, Places and Manner of holding lections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Place of Chusing Senators.

Article II Section 1 Clause 4:

The Congress may determine the Time of chusing the Electors, and the Day on which they shall give their Votes; which Day shall be the same throughout the United States.

2 USC § 7: Time of election

The Tuesday next after the 1st Monday in November, in every even numbered year, is established as the day for the election, in each of the States and Territories of the United States, of Representatives and Delegates to the Congress commencing on the 3d day of January next thereafter.

3 USC § 1: Time of appointing electors

The electors of President and Vice President shall be appointed, in each State, on election day, in accordance with the laws of the State enacted prior to election day.

The Constitution gave Congress the power to set the dates for the election. Congress set that date for federal elections in 2 USC § 7 and 3 USC § 1. The Article V Supremacy clause makes these statutes override state election laws regarding federal races.

The states are not following the federal law for conducting federal elections "on election day" singular.

For convenience, the states have bundled both the state and federal elections onto a single ballot, and then held those elections on floating durations that are inconsistent across the several states.

By law, the federal elections are to be held on ONE DAY - the first Tuesday after the first Monday in November.

SCOTUS should be asked to rule on this so that the states are forced to separate the federal ballots from the local ballots and only count the federal ballots that are cast ON ELECTION DAY as prescribed by law by Congress via the power given in the Constitution.

County election officials should have no leniency to disregard the federal statutes for federal ballots. For state elections for state and local offices, the state can count those ballots for as long as they want.
