A Houston federal court judge dismissed a lawsuit by Kash Patel that claimed Frank Figliuzzi defamed the FBI director in a comment on the MS NOW show “Morning Joe.”
Figliuzzi, a former FBI official, had said Patel has “been visible at nightclubs far more than he has been on the seventh floor of the Hoover building,” the FBI’s headquarters in Washington, D.C.
“Figliuzzi’s statement is rhetorical hyperbole that cannot constitute defamation,” U.S. District Court Judge George Hanks Jr. wrote in his decision.
The lawsuit is unrelated to the $250 million defamation lawsuit that Patel filed Monday against The Atlantic magazine over an article that alleged he has abused alcohol.

I can see why Kash would be upset if this is not true, even still, it’s not much of a case to sue on.
What’s the term?
Some lawyer might call the commentary nothing more than
“Hyperbole”: A figure of speech using a non literal exaggeration to emphasize a point., made to evoke strong feelings and/or humor.”
There is but a thin line between hyperbole and straight up Slander; A false spoken statement that damages a person’s reputation. A statement made where speaker is aware that it’s not true.

1) If a democrat or lefty says it
2) if the slur is against a republican

But Michael Mann’s ludicrous lawsuit was a success.

Doesn’t take a genius to understand the damage part.
This was supposed to be his slam dunk case. The Atlantic case will be much harder to win, especially with the problems he’s dealing with.
So it's official. The news reporting networks are "The View", and are not credible as a source of fact for the American people.

Since when is “rhetorical hyperbole” when used to slander someone legitimately considered immune from causing defamation of a persons character.
