A federal appeals court on Tuesday lifted a judge’s order requiring officials to dismantle “Alligator Alcatraz” in response to a lawsuit filed by environmental groups.
The U.S. Court of Appeals for the 11th Circuit agreed with the Trump administration in a 2-1 vote that there wasn’t enough federal control over the immigration facility’s construction in Florida to trigger a federal environmental review.
“Federal officials made no construction decision capable of triggering the Act,” wrote U.S. Circuit Judge William Pryor.
Florida constructed the detention facility last year to assist with immigration enforcement. Located at the Dade-Collier Training and Transition Airport in the Florida Everglades, migrants began arriving in July, and the Trump administration has cast it as a model that can be used elsewhere.
Two nonprofits, Friends of the Everglades and the Center for Biological Diversity, along with the Miccosukee Tribe, challenged the construction.

Even if the Department of Homeland Security (DHS) and Immigrations and Customs Enforcement (ICE) were required to conduct environmental reviews, the majority ruled that parts of the judge’s order would run afoul of another law that limits courts’ ability to intervene in immigration enforcement matters.
“Ongoing control of operations—and the provision of technical support for those operations—is irrelevant to whether the construction of the facility required an environmental review,” Pryor wrote.

It’s amazing the courts’ ruling on who has standing depending on who is President. For leftist judges, Republicans never have standing when filing against a Democrat administration. Democrats always have standing when it is in the reverse.
