The Trump Administration, via the Office of Legal Counsel (OLC), issued a Memorandum Opinion on January 15, 2026, pertaining to the general ban on the mailing of handguns by use of the Postal Service. The Memorandum declared the federal ban on mailing handguns to be unconstitutional. This was a significant step toward restoring rights traditionally protected by the Second Amendment.
Our history is full of famous figures ordering firearms by mail, from Bat Masterson to President Theodore Roosevelt. In 1927, a federal law banning the mailing of handguns went into effect. It is widely regarded as the first federal firearms law.
The Congressional record of the debate shows the purpose was to prevent black people from circumventing existing state and local handgun bans on the carry of concealed weapons by black men.
“Here we have laid bare the principal cause for the high murder rate in Memphis–the carrying by colored people of a concealed deadly weapon, most often a pistol. Can we not cope with this situation?” – Senator John K. Shields (D-TN), 1924
It took time for the act to be passed and become law. Senator Shields said the primary purpose was to prevent black people from circumventing state and local bans on the possession and carry of concealed handguns. This was done through the interstate shipping of handguns. Shields asserted that no law-abiding citizen had any lawful reason to carry a concealed weapon. The ban only affected the postal service. Private shippers were not banned from shipping handguns.
The current regulation proposed by the Postal Service is designed to bring postal regulations back into conformity with the Constitution, or at least with the OLC Memorandum’s finding.

Like a republican ballot they will “ lose” the firearms.
Leftist outrage - “Does this mean we can mail nuclear weapons!”
There is a high rate of firearm thefts when shipped via UPS. The USPS needs to do better, but I have little hope.
Waiting for the left to say they can put stamps on illegals and it’ll be okay?.
Yeah and the postal workers will steal them.
Only a complete IDIOT would use the USPS for any of their so-called ‘services’...
What about the 105mm howitzer I ordered? Still waiting.
“Here we have laid bare the principal cause for the high murder rate in Memphis–the carrying by colored people of a concealed deadly weapon, most often a pistol. Can we not cope with this situation?”
He ain’t wrong. Unpopular, but truth.
Which is likely why the Postal Service banned their shipments.
I suspect a lot of postal carriers are "prohibited persons" - both direct hires and contracted carriers.
I also suspect the change to the blue drop-off mailboxes, from the drop door to slots, was due to theft of small packages from the boxes by carriers, and by people who had stolen keys to the boxes.
I have even less hope, given what I think I know of big problems with insider mail theft that date back half a dozen years and more. This in ATL area.
That said, even though I would NOT ship a firearm via the USPS, this was the right thing to do.
Now, go FIND EVERY official responsible for that ban, cancel their pensions and/or terminate them. When I say that I have had ALL of this I can take, I mean every word.
I bought my son a 9mm for his birthday and so had to ship it to him in California. What a pain in the ass. USPS was out of course, and my neighborhood UPS store said they don’t ship firearms just as a store policy. I had to track down a local FFL and ship it to an FFL in Oakland. I had to pay $75 on my end and he had to pay $45 at his end when he picked it up. What nonsense.
Way back in mid 1968 I ordered a handgun through the mail which was to be shipped by Railway express. When it arrived the shipping costs were almost as much as the handgun! And the box it came in had a big red tape on it yelling FIREARMS!
I had a gun dealer in Little Rock Ar tell me that often the conductor on the train would call ahead and have people waiting at a certain cross roads. As the train went by he would toss those packages labeled FIREARMS off to the waiting cars.
Last forearm I ever got through the mail was a few years back from the CMP. I had to go to the PO to pick it up.
The question I would have is why would anybody trust the USPS to actually deliver a package in a timely manner, and to the correct destination? Watching the circuitous path that my latest package has taken over the last 10 days (and it’s still not here) where it came into town to the main sorting center, then off to a remote suburb on the other side of town, then off to Chicago, and then back into town - and allegedly out for delivery today. And that’s just a box with some solar landscape lighting in it.
Would you trust these DEI idiots with a firearm?
This is all BULL SHIT. Americans in a number of States are having their 2md Amendment rights violated and heve been violated for years by these Dem States and THAT is what needs fixed.
It IS legal for handguns to be shipped by the USPS - but ONLY if you possess a Federal Firearms License. It’s been that way since the 1968 GCA. Unlicensed persons can ship long guns via USPS with no problem, I do it all the time.
Send them via registered mail. Everyone that handles the package has to sign for it.
The post office tries to talk you out of sending stuff via registered mail because it’s a pita for them.
Look on youtube, there was a recent story of a guy losing an Uzi out of Detroit in the mail. Again in all likelihood stolen by the usps workers
