Supreme Court seems skeptical of allowing states to accept late-arriving mail ballots

The Supreme Court‘s conservative majority sounds skeptical of state laws that allow the counting of late-arriving mail ballots, a persistent target of President Donald Trump.

The court heard arguments in a case from Mississippi that could also affect voters in 13 other states and the District of Columbia, which have varying grace periods for mail ballots. The decision may also impact an additional 15 states that have more forgiving deadlines for ballots from military and overseas voters.

A ruling is expected by late June, early enough to govern the counting of ballots in the 2026 midterm congressional elections.

What to know:

The case: The issue at hand is whether federal law sets a single Election Day that requires ballots to be both cast by voters and received by state officials. The court challenge is part of a broader attack by Trump on most mail balloting, which he has said breeds fraud despite strong evidence to the contrary and years of experience in numerous states.

The justices: Several conservative justices, including Samuel Alito and Brett Kavanaugh, voiced some of Trump’s complaints with questions about the prospect of rigged elections or fraudulent late-arriving ballots. The court’s liberal justices, conversely, indicated they would uphold state laws with post-Election Day deadlines, largely as a matter of upholding state rights over their own voting rules.

The implications: If the court strikes down the grace periods, it’ll leave some states and their voters scrambling to adjust with only a few months before absentee ballots are sent out this fall.

If an azho can’T get their ballots in before the end of election day, THE IDIOT SHOULD NOT BE VOTING. FENTANYLES AND METHITES SHOULDN’T BE VOTING ANYWAY. They have low I.Q.s and damaged brains.

States have rights. We must accept that in the Constitution, the X amendment said so. Those rights do not include the ability to ‘fix’ elections. What if we made it so that a state could receive ballots 200 years after an election? What is the rational cutoff date? The ability to run an election is different from having a continuous and changing election. The SCOTUS has to see that votes need to be counted by ‘election day’ and not come in 200 years later.

It drives me crazy. States are already voting year round. People who can’t get a ballot in before one of the poll closing times definitely should not be voting. They are living on a different planet at a different time.

Gee I am so old I recall when voting day was exactly that, ONE DAY. You could upon application get an absentee ballot. That ballot had to be post marked on or before election day.

Mass mailing of ballots is an abomination and should be removed everywhere. Absentee ballots should be the exception not the rule.

What commies always do is once they find out how many votes they are losing by, they stuff the ballot box late and they end up “Winning” just like what happened here in California, Republicans lost 5 seats because of “Late ballot voting” every single Republican was leading and then POOF, the lead was gone after 3 weeks of counting ballots thats how the scam works

100%. I think Roberts will split the baby on this again. States can have arbitrary grace periods for state and local elections but not for federal elections because of the supremacy clause.
