Court packing? Utah gov. Cox, GOP lawmakers pass Utah Supreme Court Expansion

Two new justices will join the Utah Supreme Court after the Legislature, bitter from repeated legal defeats, passed a bill to expand the state’s high court from five to seven members.

Utah Gov. Spencer Cox, who will nominate the two new justices, quickly signed the bill into law, his office announced Saturday. After filling the new seats, Cox will have appointed five of the seven justices.

“I would err on the side that seven sets of eyes reviewing the most complex and difficult issues our state has ever faced is better than having only five sets of eyes,” said House Majority Leader Casey Snider, R-Paradise, a sponsor of the expansion.

I'm fairly sure SL Trib is massive slanted, however the problems with court packing are quite obvious.

What is happening in Utah??? Why does the Utah GOP feel so desperate it needs to add more judges in a court packing scheme?

Court packing is just so icky. It's gross.

I am curious as to what the UTAH supreme court rulings were and in what cases that caused this. Is this a GOPe thing of a conservative thing?

It appears to be both. From the linked article:

“…In addition to dealing the Legislature a crushing blow in the redistricting challenge, the courts have, in recent years, blocked Utah’s ban on most abortions, temporarily stopped a law banning transgender girls from playing high school sports, and found the state’s school voucher program unconstitutional….”

I floated this idea on the Beck show two weeks ago. He almost had a meltdown. Said this would be the end of the republic. Though I don’t necessarily disagree with his view, I felt it might prompt the demons and pubbies to react and push an amendment to limit SCOTUS to 9 so if the demons get in charge again they won’t be able to load the court which I think we all know they will do if they have control of the senate and executive branch. interested in freeper’s thoughts.

How are Utah’s Supreme Court nominees selected? Are they nominated by the Governor? Utah’s governors are usually pretty conservative, I thought.

It sounds like they are some Earl Warren’s and David Souter’s who slipped thru the cracks and were nominated...

I would be more in favor of eliminating the court, then reinstating it with new justices. Basically fire the tyrants stopping the will of the people.

I don’t believe the will of the people should be what the court uses, rather the constitution and laws passed by congress and the president. They also need to reign in the lower courts so they put an end to the judicial tyranny of federal judges. Finally the congress needs to impeach those judges that are out of control in lower courts. But congress is spineless when it comes to doing what is right for the will of the people. my 2 cents.

Judges in the performance of their office should be totally apolitical. All that should matter to them should be the FACTS and the LAW of the case on which they are deciding. Any judge who renders a decision based on political preferences must be impeached.

They are using their own political biases to go against the laws and stop the will of the people. They shouldn’t but they do.

Better yet make it 8-even number. That way it’s more unanimous. 5-4 decisions are too decisive.

I suspect that the Court case is the one that totally created a Dem district out of air. I also suspect that the rush is to seat the new Judges before the appeal of that case reaches the Utah Supreme Court, if it hasn’t already.

Given the examples you listed this action was needed. I hate the idea of it but something went very wrong with Utah’s SC nominations.
