Appeals court declines to order lower court to sign arrest warrants against Don Lemon, others in church protest

A federal appellate court on Friday declined to order a lower court judge to sign arrest warrants against five people, including former CNN anchor Don Lemon, in connection with an anti-ICE protest inside a church in St. Paul, Minnesota. *** [T]he Justice Department asked the appellate court to compel the U.S. District Court in Minnesota to sign five arrest warrants over civil rights charges alleging the defendants were unlawfully interfering with the churchgoers' constitutionally-protected freedom to practice religion.

*** Chief Judge Patrick Schiltz for the U.S. District Court for the District of Minnesota said that Micko only found probable cause on three of the eight arrest warrants presented to him by the department on Jan. 20. ***

"What the U.S. Attorney requested is unheard of in our district," he wrote. He told the department he needed more time to confer with other judges because it was such an unusual demand, and it would normally be addressed by the Justice Department either re-submitting an improved affidavit with the criminal complaint, or by seeking a grand jury indictment.

Citing national security concerns, he said the Justice Department claimed that getting the five warrants signed was an emergency, and if he did not act urgently, then "copycats will invade churches and synagogues" this weekend. He said the department claimed he must accept their national security concerns as true "because they said it, and they are the government."

He added that he disagrees with their claims, noting that the worst behavior alleged against the protestors is that they were "yelling horrible things."

"None committed any acts of violence," he wrote. "There is absolutely no emergency."***

The DOJ will hopefully craft better affidavits and resubmit them to the magistrate. It really isn’t that complicated. Say the magic words and the magistrate will usually issue the warrants. If the magistrate is crooked, there are a number of ways to get around him.

I have no idea why the DOJ didn’t do this before seeking the unprecedented intervention of the U.S. Court of Appeals.

The question to ask is—what would the court do in identical circumstances if it was white nationalists as defendants and the incident had taken place in a black church?

And the people praying in front of an abortion abattior aren't committing any acts of violence, but these same judges wouldn't hesitate for a moment to jail them and declare them guilty before they even went to trial.

The Abortion protesters have to contend with the FACE Act (see 18 U.S. Code § 248. It appears that the same law could be applied to Lemon (if he wasn’t black, of course)

This US Court idiocy is pure affirmation that US society has entered the open warfare stage of governmental overthrow and subversion of citizens rights to peacefully assemble for religious worship on private property.

All Christian churches are now targets and it is open season for insurrectionists and anarchist communist terrorists to disrupt every church gsthering as they may choose.

Anarchy is what the judges have affirmed and protected as action against every church, not just this one.

It seems the collapse of the Constitution is near in this culture wat thrust upon us by terrorist communists like Don Lemon.

These extremist terrorists are shutting down access to public air transportation and any way to possibly inhibit personal freedom and liberty.

When does this go full kinetic? That dead nurse guy was armed to the teeth. And speaking of teeth, these animals bit off the finger of a federal officer.

If this is not insurrection, what is?

President Trump; Insurrection Act much? It’s time.

It is time to arrest the mayor and the governor for sedition, treason and failing to govern and protect federal officers, declare insurrection, and bring in the Marines to restore public order.
