Immigrants often don't open the door to ICE, but that may no longer stop officers

Since coming to the United States 30 years ago from Mexico, Fernando Perez said U.S. immigration officers have stopped by his home numerous times, but he has never once answered the door.

“There are rules and I know them,” said Perez, speaking in a mix of English and Spanish in a Home Depot parking lot where he has routinely sought work as a day laborer from contractors and people renovating their homes.

Over the decades it has become common knowledge in immigrant communities across the country to not open the door for federal immigration officers unless they show a warrant signed by a judge. The Supreme Court has long held that the Constitution’s Fourth Amendment against unreasonable search and seizure prohibits the government’s forced entry into someone’s home.

As a result, immigration officers have had to adapt by making arrests in public, which often requires long hours of surveillance outside homes as they wait to nab someone walking to the street.

But an internal Immigration and Customs Enforcement memo obtained by The Associated Press states immigration officers can forcibly enter people’s homes without a judge’s warrant, marking a dramatic shift that could upend the legal advice given to immigrants for decades.

The change comes as immigration arrests nationwide soar under a mass deportation campaign by President Donald Trump’s administration that is already reshaping enforcement tactics in cities such as Minneapolis.

Perez said officers in the past would knock, wait and then move on.

“But if they are going to start coming into my home, where I am paying the rent — they are not paying the rent — that's the last straw,” he said.

I don’t think this article is correct. There are federal warrants being issued by federal judges.

The article presents this as no warrants. I don’t think this is true, just bypassing local judges.

Willing to be corrected.

So Fernando Perez has been here around 30 years and still cannot speak US English clearly nor has he applied for citizenship.

While I realize that his ties to Meh-Hee-Ko may no longer exist and he has mucho family here in the USA, IMHO he is a silver ribbon(gold is for the really bad illegals) candidate for deportation. He has had more than enough time to get legal.

Looks like this will go to court when the arrests start taking place.

I'm sure glad I'm not an illegal alien nor a landlord of an illegal alien. Doors aren't cheap.

The memo authorizes ICE officers to use force to enter a residence based solely on an administrative warrant to arrest someone with a final order of removal.

So, yes you are correct. The article is leftist trash.

Thirty years illegally in the U.S. and still speaking in a mix of English and Spanish. That’s some assimilation.

My grandpa came from Denmark. I only heard him say one word in Danish—’Bedstefar’ (grandpa).

Boo hoo for them... ICE uses two types of civil administrative warrants:
Form I-200 warrants authorize ICE to arrest people suspected of violating immigration law.
Form I-205 warrants authorize ICE to remove aliens with final orders of removal from the United States.

Articulable Reasonable Suspicion should suffice.

The illegals mere presence anywhere in the country is a “crime in progress” that officers are able, and in fact obliged, to address with or without a judge’s prior approval, “private property” notwithstanding. Anyone harboring or assisting them should also be charged.
