South Dakota Governor Plans to Deregulate Suppressors

South Dakota Governor Larry Rhoden has announced that one of his priorities for 2026 will be to deregulate suppressors/silencers in South Dakota. Governor Rhoden stated he announced his decision support on December 4th.  From dakotabroadcasting.com:

After congress passed the One Big Beautiful Bill earlier this year, silencers or suppressors were deregulated on a federal level. Governor Rhoden says he plans to bring legislation to deregulate these firearm accessories on the state level…

December 8, 2025, South Dakota Senator Casey Crabtree announced he is introducing a bill to deregulate silencers in the state. Governor Rhoden announced his support for the measure shortly after Senator Crabtree.  Brandon Maddox, CEO of Silencer Central, also pronounced his support. From dakotawarcollege.com:

“Silencer Central is proud to support South Dakota’s proactive deregulation of suppressors as ‘controlled weapons,’ and we hope the federal government will quickly follow our home state’s pro-gun, pro-freedom initiative,” said Brandon Maddox, founder and CEO of the Sioux Falls-based suppressor retailer. “Earlier this year, we won a huge national victory as the One Big Beautiful Bill removed the $200 stamp fee on suppressors and other common firearms. Now, Senator Crabtree’s bill carries that momentum forward for South Dakota.”

Senator Casey Crabtree is a Republican and Majority Whip in the South Dakota Senate. Bills he introduces have a habit of being passed. He is running for the United States House of Representatives in 2026. The South Dakota United States House member, Dusty Johnson, will be leaving office to run for the South Dakota Governor’s office in 2026.

The entire objective of gun laws is to impose burdens on gun owners. When they’re challenged, gun control supporters can’t provide any evidence that most gun laws have impacted public safety. Waiting periods, magazine capacity limitations and registration requirements are statistically ineffective but accomplish harassment/inconvenience to those who want to stay in compliance.

I thought it failed.

I remember talk of proposing to remove surpressors from NFA but I thought the BBB wouldn’t pass with that so the GOP removed it from the bill.

You mean they snuck it back into the bill or something?

Last I knew silencers (aka suppressors) manufactured, sold and used in TX had required no tax stamp and had no restrictions.

The fee of $200 was removed but not the $0 registration requirement.

They could not remove the law but they could set the fee to $0.

Speaking of silencers, the elimination of that $200 tax stamp makes buying one a little more affordable. With that said I’m contemplating getting one for an AR15 so I can target shoot closer to home without upsetting neighbors.

For those of you that have a suppressor on an AR15 or other weapon, how do they affect accuracy and overall operation of the weapon? Do they increase barrel back pressure which affects the cycling of the bolt? Can I shoot the weapon without hearing protection?

Regulating suppressors because of quiet movie assassinations with their “phut-phut” sound, is as stupid as banning switchblades because of dancing Puerto Rican gangs.

Let’s ban automobile mufflers to prevent quiet bank robbery getaways.

At least the prevalence of suppressors is one thing the Europeans get right, when they allow guns at all.

Good luck with that.

Texas tried and failed just recently - suppressors made in the state and not sold elsewhere. Down in flames.

Texas and South Dakota do not need federal permission to deregulate silencers at the state level. They only need to change state law. Texas has already done so.

The Texas law included a directive to the AG to file a federal lawsuit claiming the Federal law was unconstitutional. That lawsuit failed. Several other lawsuits challenging the federal law are in the works.

The Texas state law is still in effect, but federal law is also still in effect. I don’t expect many, if any, federal prosecutions for possession of a silencer in Texas.

That's excellent news. I purchased one thru Silencer Central back in 2024 for my .22 and the darn thing cost as much as the .22 I was buying it for. It also took 6 months to get the stamp.

Hopefully, since there are no longer restrictions on purchasing them, the prices might come down.

The taxes will be gone, but the silly registration requirements remain. They are being challenged in court.

The ATF says it is revamping its electronic application procedure to speed up the process.

Decent odds on a court saying the regulations have no reason for existence without the tax.

For those of you that have a suppressor on an AR15

I've read that the AR 15 has a noise rating of 165 db. With a suppressor, it's only reduced to approx. 135 db.

The one I have for my .22 is still relatively loud. I'm not sure it was worth it.
