The Pentagon on Monday said that it was reviewing what it called “serious allegations of misconduct against” Sen. Mark Kelly, an Arizona Democrat who was recently harshly criticized by President Donald Trump for urging members of the military to refuse to follow unlawful orders.
The Defense Department did not reveal the claims against Kelly, who is a retired captain in the U.S. Navy. The department also did not say who made the allegations.
But in a post on X, the Pentagon said that a “thorough review of these allegations has been initiated to determine further actions, which may include recall to active duty for court-martial proceedings or administrative measures.”

§2387. Activities affecting armed forces generally
(a) Whoever, with intent to interfere with, impair, or influence the loyalty, morale, or discipline of the military or naval forces of the United States:
(1) advises, counsels, urges, or in any manner causes or attempts to cause insubordination, disloyalty, mutiny, or refusal of duty by any member of the military or naval forces of the United States; or
(2) distributes or attempts to distribute any written or printed matter which advises, counsels, or urges insubordination, disloyalty, mutiny, or refusal of duty by any member of the military or naval forces of the United States—
Shall be fined under this title or imprisoned not more than ten years, or both, and shall be ineligible for employment by the United States or any department or agency thereof, for the five years next following his conviction.
(b) For the purposes of this section, the term "military or naval forces of the United States" includes the Army of the United States, the Navy, Air Force, Marine Corps, Coast Guard, Navy Reserve, Marine Corps Reserve, and Coast Guard Reserve of the United States; and, when any merchant vessel is commissioned in the Navy or is in the service of the Army or the Navy, includes the master, officers, and crew of such vessel."

It is fine to say “don’t obey illegal orders.” The military teaches that to every service member and for good reasons.
But instructors don’t just say “don’t obey illegal orders”; they provide context and real world examples to minimize any chance of confusion.
Kelly and the others - apparently - did not provide context or examples. At least I have not read that they did.
If I were a first grade teacher I would tell students don’t ever obey a federal law that is unconstitutional. Then I would provide examples; like don’t obey a law that infringes on your second amendment rights.
