A Tennessee state court judge temporarily blocked on Monday Republican Governor Bill Lee's deployment of National Guard troops to the city of Memphis, ruling that the use of troops was likely not legal under the state's militia law.
Chancellor Patricia Head Moskal of the Davidson County Chancery Court in Nashville said the militia law required Tennessee's General Assembly to call in the National Guard for public safety.
She ruled that crime rates in Memphis were not a "grave emergency" or "disaster" that would authorize Lee to send troops in his role as commander-in-chief of the state’s military forces. Her order blocks the governor from "continuing the activation and deployment of Tennessee National Guard personnel" pending further court proceedings. But it will not take effect for five days, to give Lee time to appeal.
National Guard troops began patrolling Memphis as part of a federal task force to combat crime after Republican President Donald Trump requested, opens new tab the deployment in September.
State lawmakers and Shelby County mayor Lee Harris sued the governor to block deployment, saying use of the troops for law enforcement violates the Tennessee constitution and state laws.
"This is a positive step toward ensuring the rule of law applies to everyone, including everyday Tennesseans and even the governor," Harris said in a Facebook post on Monday.
Memphis is one of several U.S. cities to which Trump has sent the National Guard, departing from norms against deploying troops on U.S. soil.
Trump has said they are needed to suppress civil unrest, support immigration enforcement and fight crime. Democrats have accused the Republican president of abusing military powers meant for grave emergencies such as an invasion.

The people who administrate and enforce the law (mayor, governor, chief-of-police,judges) DON’T want the NG in their state because it would expose them as powerless to stop the rise in violent crime or as allowing that crime to continue for financial benefit.
The whole purpose of the National Guard is to bring in armed support when local politicians, law enforcement, medical staff are ‘overcome’. The National Guard keeps the Nation from losing a territory to outside forces. Whether those forces be tornados, hurricanes, or terrorists. The people suing the President to stop the NG are more concerned with losing their power and wealth. They aren’t even man enough to say “let’s fix this first, then we can argue about why it happened.” Because they can’t. Because they are afraid. They are afraid the public will see them for what they truly are.
Seems like judges need to have a governor-like status, and be voted into place.
This judge needs to be removed for causing an emergency.
She is a crime against humanity.

What WERE her noted definitions for ‘grave emergency’ & ‘disaster’? If based on nothing but her F-E-E-L-Z, ignore for not being based on Law & continue as normal.
Side note: See, this is where, if we still had a Const. Republic, these types of ‘laws’ would be null/void for vagueness. But, govt == lawyer jobs-program & specifics don’t allow the shark-food/lawyer class any wiggle room.
I feel the judge may be correct according to Tennessee law. Maybe the law needs changing.
I will give her credit for delaying implementation of her decision to allow for an appeal. A true leftist tyrant-in-black-robe would have issued an immediate injunction.
