The 9th Circuit Court of Appeals will rehear the Trump administration’s appeal to deploy and federalize the National Guard to Portland, OR.
The “majority of nonrecused active judges” voted to rehear the case en banc.
En banc requires the approval of a majority of the judges of the 9th Circuit. In this case, the panel will consist of eleven judges.
Last week, a three-judge panel froze a lower court order that stopped President Donald Trump from sending the National Guard to Portland.
U.S. District Judge Karin Immergut placed two restraining orders on Trump: no federalization of the Oregon National Guard & sending in the Oregon National Guard, and no sending in the California National Guard.
The 9th Circuit already lifted Immergut’s order restraining Trump from federalizing the Oregon National Guard.
What's cute is the Portland Police department clearing out the Antifa camp in preparation for this hearing when they haven't done diddly squat all summer.
The protestors/antifa will be back twice as hard once the decision comes out and it won't be pretty.
I wonder if they have a good dental plan.
I bet they get retirement benefits too, although there are a lot of gray hairs in those protestor ranks.

But it’s become self evident .
At this point the 9th has done both. The 3 judge panel overruled the federal judge that forbade it in a pretty scathing decision.
Now the 9th has decided to hear it en banc and vacated the 3 judge panel’s ruling.
I have no doubt that regardless of what the en banc panel decides, it will be appealed by the losing side to SCOTUS.

Looks like that's what they're doing here, and that decision will be precedent for the whole 9th Circuit, including CA, and not just Oregon.
Coordinators probably had it cleared to argue the case is moot. There was a similar tactic to where they would pass clearly unconstitutional ruling and then rescind them right before court if they thought it would be overturned. IIRC it was a common legal tactic during despotic covid rules.
Another Circus stunt from the clowns at the 9th Circus. The most worthless piece of weaponized judiciary in the universe.
