Lawyer says truck involved in fatal I-68 collision ‘never should have been on the road’

CLARKSBURG, W.Va. (WBOY) — A law firm representing the family of Kevin Lataille is filing a federal lawsuit against the driver of the tractor-trailer that crashed into Lataille’s vehicle on Jan. 19, causing it to go into Cheat Lake, alleging the driver knowingly did not report the fatal collision.

The Monongalia County Sheriff’s Office announced Monday that a warrant has been issued for the driver, Sukhjinder Singh, of New York, for negligent homicide. Investigators said Singh was driving recklessly in a snowstorm when he hit Lataille’s vehicle, and that it led to Lataille’s death.

Deputies said in a press release that Singh denied hitting any vehicles, but surveillance footage from the area “revealed a large vehicle sliding on the bridge, throwing snow into the air, and a separate passenger vehicle falling from the bridge into the lake,” and investigators determined that the vehicles were those driven by Singh and Lataille.

Vehicle being recovered from Cheat Lake on Jan. 26 In an interview with 12 News, Dino Colombo from Colombo Law, who is filing a federal lawsuit against both the driver and trucking company on behalf of the Lataille family, alleged the truck should not have been on the roads during the snowstorm, which dumped more than 6 inches of snow in Morgantown, and that the driver was aware that his reckless driving caused Lataille to go off the bridge.

Old story. Truck was driving fast in snow. Pushed car off of the bridge into the lake. Driver, Singh, did not stop, and pled guilty to misdemeanor negligent homicide.

Hope for huge verdict so insurers will stop insuring these trucking businesses.

Enough incidents like this should make the Federal Transportation Agency impose sanctions on those states that issue clearly incompetent drivers commercial licenses. If states like California and New York issue licenses to drivers who cannot speak or read English or who are incapable of driving an 18 wheeler over the road, commercial license holders from those states should be barred from interstate commerce.

its a very good step, but that won't fully deter the illegal indian operations, which are many.

They've already broken many laws, so having fake or manipulated insurance documents is not big thing. The big question is - will blue-state politicians and especially judges care about it? Probably not.

I’m starting to believe that these accidents are intentional - by the Democrats. Another way of sowing discord and encouraging violence.
Once one right minded people loses it and goes vigilante dems will have the excuse they crave to release their demented hoard on all of us.

UNINSURED DRIVERS IS ALMOST 49% OF MY 1976 1 TON TRUCK INSURANCE.

CANNOT DROP IT, EVEN THO I DO NOT DRIVE TRUCK MUCH-—I OWN ALL MY PROPERTY FREE & CLEAR.

You cannot pass a weigh station in a commercial vehicle without proof of insurance to include worker’s comp. You will be red tagged.

If a commercial hauler cannot get insurance they simply cannot operate.

What will happen is this will cause commercial insurance cost to increase. Depending on who I drive for and what I am hauling, commercial vehicle insurance is between $2k and $6k A MONTH.

There’s talk of upping the minimum coverage by a few million which may double commercial vehicle insurance.

Remember, end user pays all and EVERYTHING comes on a truck.

Everything will cost more.

No. The accidents themselves are not “deliberate”

The ATTITUDE and ENVIRONMENT that created the bureaucracy and the slack laws that encouraged and funded and enabled the lax immigration and wholesale flaunting of visa-stay-over-failures, and open borders, and walk-ver-the-border invasion IS deliberate.

They do have some high mountains with snow in India, but the first seven words still ring true to me. Seems as if a major problem with over-the-road trucking has been exposed. Time to hire American drivers.
