U.S. District Court Judge Mary S. McElroy has issued an injunction preventing the Department of Homeland Security (DHS) and the Federal Emergency Management Agency (FEMA) from redirecting $233 million in Homeland Security Grant Program funds, following a lawsuit by a coalition of Democratic-led states.
The decision comes amid concerns that the reallocations have curtailed vital counterterrorism and emergency preparedness resources. Additional states are considering joining the litigation, citing potential impacts on national security funding, as the case progresses.
McElroy said, “This sort of last-minute changing of the way the funding happens, and especially when it happens right in the wake of Judge Smith’s decision, is concerning.”
The lawsuit, spearheaded by Illinois and supported by 11 states and the District of Columbia, alleges that FEMA altered grant awards without adequate justification, potentially violating the Homeland Security Act by targeting jurisdictions with differing immigration policies......
DHS Assistant Secretary Tricia McLaughlin said, “Cities and states who break the law and prevent us from arresting criminal illegal aliens should not receive federal funding.”
State attorneys intend to pursue complete administrative records and legal briefings to evaluate DHS’s adherence to statutory requirements.
Rep. Nick LaLota (R-NY) said, “America’s Worst Governor can’t have it both ways—pushing a shutdown while expecting Washington to bankroll New York. And she certainly can’t push reckless sanctuary policies, back a defund-the-police mayoral candidate, and then stick federal taxpayers with the bill for the chaos she created.”

In this case THE STATES need to exercise their constitutional state sovereignty and INDEPENDENCE and refuse federal funds which makes them slaves to the feds.

Forgive my ignorance, but when Congress passed the law authorizing the funding of the Homeland Security Grant Program, did the legislation actually say how much money was to go to each state? Or did U.S. District Court Judge Mary S. McElroy get to decide that on her own?
