Judge threatens to dismiss Trump Georgia case in 14 days if new prosecutor is not assigned [Fani Willis]

Fulton County Superior Court Judge Scott McAfee on Friday gave the Prosecuting Attorneys’ Council just 14 days to assign a new prosecutor to Fulton County District Attorney Fani Willis' 2020 Georgia election interference case or the case will be dismissed.

McAfee said he would dismiss the case against all the defendants, which includes President Donald Trump and Rudy Giuliani, if a new prosecutor was not named or an extension request was granted.

File Judge Scott McAfee order "The Georgia Court of Appeals having disqualified the entirety of the Fulton County District Attorney’s Office from further handling of this case, the duty falls on the Prosecuting Attorneys’ Council to identify a replacement," he wrote in the order. "Should an appointed prosecuting attorney or representative of PAC fail to file an entry of appearance or request a particularized extension within 14 days from the entry of this Notice, the Court will issue a dismissal without prejudice for want of prosecution."

I guess the judge is hoping some prosecutor in Georgia will step forward to take the case so he is giving them time to do so. I doubt his wishes will be granted. Who would want the headaches or the destruction to their reputation?

Besides, if a county prosecutor wanted the case, they would have to get permission from their Board of Commissioners to take it on due to the time and funding it would entail. I don’t think many commissioners want the three-ring circus in their county.

Not how it works in Georgia. Base pay comes from the state. DAs don't work for the county. In fact, many of the Districts are multi-county. (50 Judicial Circuits, 159 counties). While the base salary is from the state, counties can offer local supplements in pay or in facilities. There is also a state supplement available if various services are performed. An irate county commission could reduce the local supplement. But they can't say "no".

Prosecutors in Georgia are judicial officers. not executive branch.

"All state paid personnel employed by the district attorneys pursuant to this article shall be employees of the judicial branch of state government in accordance with Article VI, Section VIII of the Constitution of Georgia and shall be in the unclassified service as defined by Code Section 45-20-2."

Flip side of the coin is apparently any licensed attorney in the State of Georgia (OK, it limits it to "competent attorney").

The judge threw Fani a life line last year, saying she smell bad but she still alive if she or her man toy leave the case.

Now he’s giving her two weeks to raise the dead. Which team he on?

County responsibilities

Salary supplements:

Counties can supplement the state-funded base salaries of district attorneys and other staff. This can be determined by the county governing authority or a local legislative act. The level of county funding can vary, especially in rural areas, where some district attorneys’ offices may not receive any county supplements.

Office and operational costs:

The counties that make up a judicial circuit are responsible for providing the physical offices, utilities, telephone expenses, materials, and supplies needed to run the district attorney’s office.

Additional personnel:

Counties can also choose to fund additional personnel for the district attorney’s office through official action or a local law.


No county is going to want to take on the extra cost that would be needed to handle a case of that size.

If I was a democrat criminal defense lawyer with political ambitions, I’d consider giving it a shot. The Fulton County jury pool isn’t exactly the cream of the crop. So there’s always a chance. And there’s a lot of hungry lawyers in Georgia that would see an $8,000 a month pay=stub from the state as a sweet deal. (DA pay for the job with only one case to worry about).

Lots of free publicity and able to advertise that you are not afraid to take on the rich and powerful
