The U.S. government has asked the Oregon federal judge presiding over National Guard case to recuse himself.
Following President Donald Trump’s announcement that he will deploy the National Guard to Portland, Oregon Attorney General Dan Rayfield filed a lawsuit in U.S. District Court against the Trump administration.
The federal judge presiding over the case is Michael Simon, who is married to Oregon Representative Suzanne Bonamici.
Bonamici is one of the members of Congress representing the City of Portland.
On Saturday, Bonamici was one of the Oregon leaders who spoke out against the deployment of federal troops to Portland.
The Department of Justice wants Simon to recuse himself to “avoid the appearance of partiality.”
“To be sure, Defendants recognize that Judge Simon and Representative Bonamici speak for themselves, not for each other. Nonetheless, the unique factual, legal, and political role that Judge Simon’s spouse has played in the central events of this lawsuit may create the appearance of partiality,” the DOJ said in the recusal filing on Thursday.
The filing comes as the federal government was given a deadline of 2 p.m. on Thursday to respond to Oregon and the City of Portland’s lawsuit.
There is a hearing in Portland federal court scheduled for Friday for a temporary restraining order that would prevent the deployment of troops under Title 10.
The request is a formality of course.
The judge was no doubt going to recuse himself in an obvious conflict of interest.

‼️ Out of Portland tonight comes a disturbing development: independent journalist Nick Sortor (@nicksortor) was arrested by Portland Police while simply doing his job on the ground.
Eyewitnesses say he wasn’t engaged in any criminal behavior—just covering events.
What makes this worse is that the same officers had refused, only hours earlier, to arrest a woman who physically assaulted reporter Katie Daviscourt (@KatieDaviscourt). That double standard makes it clear this isn’t law enforcement, it’s political enforcement.
Video shared by @yogashortsss shows Sortor being hauled off in handcuffs amid the chaos. The footage is exactly what it looks like: an attack on press freedom by a police department that protects violent agitators while targeting the people exposing them.
Portland PD has crossed the line.
