I don’t remember anything in the Constitution about “independent” agencies beyond the reach of the President.

Probably another reason FDR threatened to pack the court. After that they dared not defy him.

What the Supreme Court is looking at, is removing unconstitutional levels of power from administrative agencies.

Yeah, I think that’s the problem. No such animal. President Trump is definitely putting the entire executive branch under the control of the elected president.

If this keeps up, the Supreme Court is going to end up ruling that the entire presidencies of Woodrow Wilson and Theodore Roosevelt were unconstitutional.

I love every moment of it. FDR wasn’t one of the original/major progressives of the Progressive Era.

The one missing piece is we need congress to start abolishing agencies and pulling back its powers.

These are not presidential powers. The FCC, OSHA, the FDA, the national parks, the EPA, Obamacare, and on and on and on and things I didn’t even name.

It needs to be abolished. All of it. Back to the states or back to Congress. It doesn’t belong with the president.

Oh yes, to be sure, fully agree. But I was opining that nothing in our constitution even hints at federal agencies free from the Chief Executive.

Getting rid of Humphrey’s Executor is exactly what needs to happen. That would be more consequential than the overturing of Roe v. Wade. It would gut the administrative state.

And that is a huge problem. There are ivy league careers built on books on the administrative state and now you want to gut all of that. One of my favorites in this category is Yalie Harold Hongju Koh who wrote "The National Security Constitution in the Twenty-First Century," published June 2024. If you look the guy up you will discover that the guy suffers from raging acute Stage V TDS. Now the Supreme Court has gutted everything the man stands for.

I can’t find the section in the constitution where Congress is permitted to create an agency in the Executive branch that is independent of the executive branch.

Ok, this is about REMOVAL.

How did the commissioners get ADDED to begin with?
