From perp walk to press conference: Defense says Mangione can’t get fair trial

Attorneys for Luigi Mangione seek to dismiss murder charges, alleging officials violated his rights and hurt his chances for a fair trial.

Attorneys for Luigi Mangione asked a federal judge Saturday to dismiss charges against him, arguing that state and federal officials violated his constitutional rights and damaged his chances for a fair trial.

Mangione is accused of killing Brian Thompson, CEO of UnitedHealthcare, in December 2024. The high-profile assassination drew national attention in the days after Thompson’s death.

Earlier this week, a New York state judge dropped two terrorism-related charges against Mangione. He still faces a federal murder charge that could carry the death penalty. His defense team is also asking the court to remove the death penalty as an option.

Mangione’s attorneys accuse state and federal prosecutors, along with New York City Mayor Eric Adams, of conduct that violated "Mangione’s constitutional and statutory rights and have fatally prejudiced this death penalty case.”

They said officials failed to note at a December news conference that Mangione is “presumed innocent” while presenting evidence against him.

Defense lawyers also objected to Mangione being “perp walked” before television cameras, calling it an act “purely to dehumanize Mangione and [that] had no legitimate law enforcement purpose.”

The attorneys further criticized the Trump administration and Attorney General Pam Bondi, who said pursuing the death penalty was part of “President Trump’s agenda to stop violent crime and Make America Safe Again.”

His lawyers argue that these incidents have undermined Mangione’s ability to receive a fair trial.

While some of the most serious charges were dropped earlier this week, Mangione still faces second-degree murder and weapons charges in the state case, as well as federal counts of murder, stalking and a firearms violation.

Get in line Mangione. Brian Thompson didn't have a fair trial either. So my advice is STFU.

Lawyers always ask for that right out of the chute, just SOP. But I hope this can move along at a better pace. It is sickening to watch the story unfold.

Well, you can’t blame the defense for taking a shot at this—that’s their job. The problem is, the prosecution can point to the public rallies and political support Mangione has already received as proof that he’s not up against an unfair jury pool.

If anything, it shows he’ll get more than a fair trial.

Vigorous defense, and all that. But, this is going nowhere.

Hey, but if they DO execute him speedily, like the OK City bomber (sorry too lazy to look up his name), then maybe they can sell tickets to the fan girls and thereby reduce the National Debt.

Mangione still faces second-degree murder

I was upset about that until I did a little searching. In most states premeditated murder is first degree. In New York it's only second degree unless there are aggravating circumstances like killing a cop or commiting another felony.

Same as dozens of TV and radio reports that forgot to include “the alleged” and “allegedly” after pushing the videos and mug shots that he was guilty.

Will the women of Luigi’s fanatical fan clubs throw down their bodies in front of police vehicles taking Luigi to the courtroom?

Police in the 1940s once said girls “swooning” over the “swell” “dreamboat” Frank Sinatra used to lock themselves into car trunks to try to get near their idol.

Luigi Mangione was not noted in his “fairness” in his summary execution of Brian Thompson, stalking from behind and taking advantage of an unguarded moment.

Motive is not to be dependent on “situational ethics”, whatever that means. Assassination is a disproportionate response to a perceived injustice.

Facts to be proved - did Mangione aim at the victim, and pull the trigger of a deadly weapon, or not?

- Has Mangione exhibited any indication of remorse for his actions?

- Is his explanation ever going to indicate he had exhausted ALL avenues in his claims for remuneration or damages?

- Has Mangione actually BEEN damaged in any way, directly or indirectly, by the actions of Brian Thompson?
