Florida Attorney General James Uthmeier declared state residents are free to openly carry guns statewide after an appeals court decision that struck down Florida’s nearly 40-year-old ban.
Uthmeier, a Republican appointed to the job earlier this year by Gov. Ron DeSantis who is running for the post in 2026, sent out a “guidance” memo Monday to law enforcement agencies and local prosecutors asserting the 1st District Court of Appeal ruling is in effect statewide.
“Meaning that of last week, open carry is the law of the state,” Uthmeier wrote on his official X account in a post that included the memo.
Uthmeier made his pronouncement amid a back-and-forth among various law enforcement agencies as to how they would handle open-carry incidents. Some, like the Jacksonville Sheriff’s Office, said they would not stop or arrest anyone openly displaying a weapon, while the Pinellas County sheriff said the ruling did not apply statewide.
The state attorney general wrote that “prudence counsels that prosecutors and law enforcement personnel should likewise refrain from arresting or prosecuting law-abiding citizens carrying a firearm that is visible to others.” He also wrote his office would no longer defend and prosecutions under the law.

No , you’re mistaken . I resided in Maine for quite a while and during the period when open carry became legal. It’s a good thing everyone is armed and polite ...very little crime with a few exceptional areas....Open carry is a good thing.

I see no problem here. Florida residents have had Constitutional carry for a while, now. No major issues I’m aware of.
In MN, I’ve seen lots of open carry in small towns, doesn’t seem to be an issue there, either.

Some county sheriffs and city PD’s don’t know how to handle an equally armed citizen. It’s sort of like a German Shepard running across another one it didn’t know. In Alaska, the troopers may ask “how many” guns a driver has, not if he has one. They may even admire each others choices.
So grateful to live in this great state!
Racist much? One of my best friends is a Latin American. Although he’d hate me characterizing him that way - his parents immigrated legally and with no small amount of danger. He considers himself an American first. He also happens to be a Constitutional lawyer.

As a long time resident of the state of Florida, there are far more good old boys in Florida than Latinos. Perhaps you should check your bias at the border or just not visit?

Open carry has been legal here in Michigan forever since there has never been a law against it, and it's never been a problem.
With that being said, I think it's ridiculous to require an individual to obtain a CPL in order to conceal it.
I’m also grateful for this ruling, but I’m going to proceed with caution. The Republicans, even those in Florida, have a nasty habit of stealing defeat from the jaws of victory.

And everyone else will also be able to “sport” them - MS became Constitutional open/concealed carry a few years back and we have fewer “incidents” than the national average, but more fatalities - I guess Mississippians aim better.
