Supreme Court stays judge order requiring Trump to spend foreign aid

The Supreme Court on Tuesday paused a court order requiring President Donald Trump to distribute roughly $4 billion in foreign aid that he has tried to cancel through a "pocket rescission," Reuters reported.

The order follows a lower court determining that Trump lacked the authority to withhold funding that Congress allocated. The 2nd Circuit on Friday upheld the district court order from Judge Amir Ali finding that Trump needed congressional authority to withhold the funds.

“To be clear, no one disputes that defendants have significant discretion in how to spend the funds at issue, and the court is not directing defendants to make payments to any particular recipients,” the Biden-appointed Ali wrote. “But defendants do not have any discretion as to whether to spend the funds.”

The best I can determine is the federal judge ruled that it mattered not how the funds were spent, as long as they were spent.

Government work, I guess.

Unfortunately, there are scores of corrupt judges willing to issue these rulings against Trump, but only one Supreme Court to ultimately overturn those rulings.

It's going to be death by a thousand cuts.

“Chief Justice John Roberts on Tuesday allowed the Trump administration to freeze billions in foreign aid payments for now, putting on hold a lower court ruling that required officials to spend $4 billion of that money by the end of the month.

Roberts, who handles emergency appeals from federal courts in Washington, DC, issued what’s known as an administrative stay – a temporary order intended to give the justices more time to review the case.

The order does not necessarily indicate how the court will ultimately resolve the appeal, though it could make it harder for the groups that sued over the cuts to recover the money approved by Congress.

Roberts ordered the groups challenging the move to respond to the Trump administration by Friday afternoon.

At issue is $4 billion in foreign aid, including for global health and HIV programs, that was approved by Congress but that President Donald Trump has deemed wasteful. Trump signed an executive order on his first day in office attempting to curtail foreign aid spending, and his administration has for months been fighting lower court orders that blocked his effort.

The spending of foreign aid is a “joint enterprise between our two political branches,” US District Judge Amir Ali wrote in a March opinion that mostly sided against Trump.

But in this case, Ali wrote, “the executive not only claims his constitutional authority to determine how to spend appropriated funds, but usurps Congress’s exclusive authority to dictate whether the funds should be spent in the first place.”

The limiting factor is in the number of cases SCOTUS can hear vs. the number of rulings pissant lower court judges can issue.

A Muslim Canadian who only recently became a US citizen (and STILL has Canadian citizenship by way of his Egyptian/Canadian parents).

His nomination in the senate was barely passed with a KumAllah Harris tie-breaker vote.
