President Donald Trump said Tuesday that he will ask the Supreme Court for an “expedited ruling” to overturn an appeals court decision that found most of his tariffs are illegal.
“If you take away tariffs, we could end up being a third-world country,” Trump told reporters at the White House.
The U.S. Court of Appeals for the Federal Circuit, in a 7-4 ruling on Friday, said that Trump does not have the authority to implement most of his tariffs.

Depends on whether or not Deep State still controls the SCOTUS.
If Deep State still controls the SCOTUS, then Deep State will have to decide whether or not to drop that last fig leaf.
Shouldn’t even have to. The lower courts is full of it.
Judge hunting law suits by nobodies. States have no say.
It’s all getting past ridiculous.
NOTHING ILLEGAL about these Tariffs. It’s all under law approved by Congress years ago and Executive Branch duties. This is absolutely absurd.
Congress first approved tariffs in 1789 with the passage of the Hamilton Tariff, which authorized the collection of duties on imported goods for federal revenue and to encourage domestic manufacturing.
Early Tariffs
1789 (Hamilton Tariff): The First Congress passed this tariff to raise money for the new government, pay off debts, and support American industries.
Congressional Authority and Delegation
Constitutional Basis:
The U.S. Constitution, Article 1, Section 8, gives Congress the power to “lay and collect Taxes, Duties, Imposts and Excises”.
Recent Tariffs
Trump Administration:
.
The Trump administration invoked IEEPA, as well as other laws like Section 232 and Section 301 of the Trade Act of 1974, to impose tariffs on various countries.
Biden Administration:
.
The Biden administration has continued to use the authority delegated by Congress to address trade issues, though with some modifications compared to the previous administration.
Hurry up and make your political finger in the air decision ftom on high....and remember, noses UP.
It would seem that only Congress has standing regarding this issue. Has the majority of Congress objected?
the neoCON free traitors are siding with the obama judge
The thing is, the Court is substituting its own judgment for that of the President’s. It doesn’t mean their policy position on the President’s authority and what he is categorizing as being a threat to justify the tariff’s doesn’t have merit, but that isn’t the role of a judge. If anything is ripe for being dismissed as a “political question”, this was it. It would be up to Congress to repeal the tariffs and they have not done so. The SCOTUS should dismiss it on those grounds.
Same with the ruling on the National Guard. The judge essentially would not have done it if they were the President, therefore, it was wrong and “illegal.” That’s even more of a case where it should have been dismissed from court as a “political question.”
Trump cited the IEEPA and i don’t think there are any tariffs mentioned in the statute. So he might want to pick another one to cite.
International Emergency Economic Powers Act (IEEPA).>>. there are no tariffs in the IEEPA.
If Trump can impose tariffs, why declare an emergency? It’s just good policy.
I always hesitate to chalk up big asset price moves to one thing, but it’s hard to ignore the headlines suggesting that the U.S. government may need to refund the billions of dollars in tariffs that have been collected over the past several months.
Think about the implications — As of July, the government took in $159 billion in tariff revenue this year – double what it was the year before. In a recent note on the U.S. debt rating, S&P Global Ratings – one of the “Big Three” credit-rating agencies – said that tariff revenue is offsetting the fiscal risk from lower tax revenue and increased spending in the “big, beautiful bill.”
If the government ends up having to return that revenue, Uncle Sam would see a bigger budget deficit... while interest rates may be headed lower via the Federal Reserve.
So if you want to bet on one thing, the continued devaluation of the U.S. dollar is a good start. Meanwhile, a “hard asset” like gold will remain an appealing asset to hold.
I’ve been told that consumers pay tariffs for the last decade. So I guess consumers will get a big hefty cheque. I love how Everyone is waiting for Trump to apply secondary tariffs and sanctions on Russia and those buying Russian oil but somehow he doesn’t have the authority to do it…or maybe they just happen to agree with THAT policy.
Most tariffs are paid by kick backs from the manufacturer to the importer.
I hate the words “ask,” “may, “ and “threaten.” They are useless words in running a government.
The Supreme Court has already told the lower courts to stop issuing universal injunctions. This is just another instance of ignoring the higher court.
One thing I do not understand is why Trump is hesitant to defy the lower courts? This is not his first term.
My understanding is that they are fearful that if the Dems should get the House majority back in the midterms it would trigger another impeachment. I’m sure they are right.
