BREAKING: Obama Judge Says Alina Habba is “Not Lawfully Holding the Office of United States Attorney”

US District Judge Mathew Brann, an Obama appointee on Thursday said Alina Habba is “not lawfully holding the Office of US Attorney” of New Jersey.

Habba resigned as Interim US Attorney and became Acting US Attorney for New Jersey after the Trump DOJ outmaneuvered the judges.

The Pennsylvania-based federal judge oversaw a challenge to Alina Habba’s authority because the judges in New Jersey had a conflict of interest after they ousted her from her position as interim US Attorney last month.

Last month it was reported that US Attorney General Pam Bondi promptly removed Alina Habba’s replacement after a group of district court judges voted to oust Habba as interim US Attorney of New Jersey.

A group of federal judges last month declined to extend Alina Habba’s term as interim US Attorney of New Jersey after Democrat Minority Leader Hakeem Jeffries launched a pressure campaign to oust her.

Alina Habba’s term as interim US Attorney was set to expire after 120 days.

However, after a pressure campaign from Jeffries, district court judges voted to oust Alina Habba as interim US Attorney of New Jersey and replaced her with Desiree Leigh Grace.

In a 77-page ruling, Judge Brann said Habba is not lawfully serving as US Attorney.

“Faced with the question of whether Ms. Habba is lawfully performing the functions and duties of the office of the United States Attorney for the District of New Jersey, I conclude that she is not,” the judge wrote. Yes, this is the same federal judge who threw out Trump's challenge to the 2020 Big Steal in PA.

Matt Brann, whom I know personally, took 77 pages to write what should have been written in at least half of that. He is a RINO who got appointed by Obama in some kind of political deal. It's highly curious that someone in U.S. Court of Appeals for the Third Circuit appointed a judge from Williamsport, PA in the U.S. District Court for the Middle District of PA to hear this case from New Jersey when there were so many more judge available in across the river in Philadelphia. Brann is a political guy. The Bard wrote that "brevity is the sole of wit", and since he needed 77 pages to make his argument, we can conclude that Brann isn't very witty. Matt can't dazzle us with brilliance, so he baffles us with BS. Yes, this is the same federal judge who threw out Trump's challenge to the 2020 Big Steal in PA.

The judge is wrong.

The specific “exception” or maneuver used by the Trump administration involved the following steps:

Withdrawal of Nomination: Trump had nominated Habba for the permanent U.S. Attorney position, but her nomination faced opposition from New Jersey’s Democratic senators, Cory Booker and Andy Kim, and was unlikely to be confirmed by the Senate. On July 24, 2025, Trump withdrew her nomination. This withdrawal was critical because the FVRA prohibits someone whose nomination is pending in the Senate from serving as an acting officer in the same role, unless they have served as the first assistant to that office for at least 90 days. By withdrawing the nomination, Trump removed this restriction, allowing Habba to be eligible for an acting appointment.

Firing of Grace: To ensure Habba could remain in the top role, the Justice Department, under Bondi’s direction, fired Desiree Leigh Grace hours after the judges appointed her on July 22, 2025. This move eliminated Grace as a competing appointee, creating a vacancy that allowed Habba to step into the acting role under the FVRA.

Appointment as First Assistant: Attorney General Pam Bondi appointed Habba as the First Assistant U.S. Attorney, the second-ranking official in the office. Under the FVRA, if a vacancy exists in a Senate-confirmed position like U.S. Attorney, “the first assistant to the office of such officer shall perform the functions and duties of the office temporarily in an acting capacity.” Since the U.S. Attorney position was vacant (after the judges’ appointment of Grace was nullified by her firing), Habba, as the newly appointed First Assistant, automatically assumed the role of Acting U.S. Attorney.

These petty tyrant judges are so used to being the potentate of their own courtrooms and the deference paid to judges in general that they forget reality. Our president out trumped them and their ego is taking a real beating. ROTFL! Way to go, Mr. President.

Well, if one can’t baffle them with brains.....

When I worked for Big 6 consulting theay would throw an avalanche of paperwork at a client. I believe all they did was basically change some words.

No one, NO ONE was going to read that pile of garbage. It was ALL part of the show.

It's what legal opinions have become, just stinking piles of B.S. form political hacks. The U.S. Attorney's serve at the pleasure of POTUS. There was a vacancy, and Trump filled it. It's not complicated. Making simple things complicated to confuse the simple minded is what our judges now do. Matt Brann is a BS artist who assisted in the 2020 Big Steal. This is all part of his legacy. He's a hack, not a respectable judge. What's sad is that he became a federal judge and not someone like me. This was't complicated.

They get away with a lot. People are wising up to them though. I am pushing for an independent court of judicial discipline for federal judges, not comprised of district or circuit court judges. The lack of discipline with judges is the problem. They are so independent they are above the law, or they claim to personify the law rather than enforce it.
