Trump’s moves toward taking over Washington are unprecedented. Here’s what the law says

WASHINGTON (AP) — President Donald Trump took unprecedented steps toward federalizing Washington, D.C. on Monday, saying it’s needed to fight crime even as city leaders pointed to data showing violence is down.

He took command of the police department and deployed the National Guard under laws and Constitutional powers that give the federal government more sway over the nation’s capital than other cities. Its historically majority Black population wasn’t electing its own city council and mayor until 1973, when Republican President Richard Nixon signed the Home Rule Act.

The measure still left significant power to the president and Congress, though no president has exercised the police powers before.

He activated the National Guard

The Constitution calls for the creation of the District of Columbia to serve as the federal seat of power under the jurisdiction of Congress rather than any state.

While the Home Rule Act allowed for greater local control, the president can still call up the National Guard in Washington. His administration did it during Black Lives Matter protests in 2020, when members were later faulted for flying a helicopter too low over a crowd. The Guard was called out again during Trump’s first term on Jan. 6, 2021, when his supporters overran the Capitol.

Trump’s second-term moves in Washington come as the legal battle continues over his deployment of the National Guard in another Democratic-led city, Los Angeles, despite the objections of Gov. Gavin Newsom.

His authority is less clear there, but an appeals court has so far refused to intervene. A lower-court judge was starting a trial Monday to determine whether the deployment violated another federal law.

Not much demand for retired ocean liner tourism. An artificial reef that people will be able to enjoy for generations to come is a much better resting place than sending her to the breakers.

Yes, Trump can do this. Trump second term is all about maximizing his powers under Article II and testing their limits. It's time to clean up the crime in D.C. It's a national disgrace.

When I was 16, I could walk the streets with a girl friend safely.

I would not attempt it today.

Nor, would I allow my granddaughters to do so.

15 years ago, I would take the metro without a thought. Today, I am aware and wary.

The demographic shift occurred gradually through the mid-20th century. During the Great Migration (roughly 1916-1970), many African Americans moved from the South to northern cities including D.C. By the 1950s, D.C. had become majority Black - reaching about 53% by 1960 and continuing to grow to around 70% by the early 1970s.
So for roughly two decades, D.C. had a majority Black population but was still governed by congressionally-appointed commissioners rather than elected local officials. The D.C. Home Rule Act, signed by President Nixon in December 1973, finally allowed residents to elect their own mayor and city council starting in 1974. Walter Washington became the first elected mayor in 1975 (he had previously served as the appointed mayor-commissioner).

Everybody forgets there were thousands of National Guard deployed in DC for months to prevent the insurrectionists from storming the Capitol again,( or for the first time, depending on POV). It was widely cheered even though they were sleeping in parking garages.

Constitutionally all of the power still lies there. It is just delegated to the DC city council and mayor. It certainly can be "un-delegated".
