The Congressional seats are apportioned according to the number of residents. In the early part of the 20th Century, the number of Congressional seats was capped at 435. It is up to the states to apportion the seats they are assigned. Supreme Court rulings in the 1960s established the principal of “one man, one vote”. Later Supreme Court rulings established that districts must be set according to population, including minors and non-citizens. The Supreme Court has also determined that apportionment is a matter for the state governments.

Riiiiiight. But they didn’t rule on the UNCONSTITUTIONALITY when a republican form of government doesn’t exist for a significant part of the population.
If the US Constitution is to be believed, the Federal Government’s mission is to endure a republican form of government. Outside of that, it is useless.

If GOP’s 40% were evenly distributed across all districts, they wouldn’t get a single seat no matter what you do.

The Voting Rights Act is due for renewal. A preclearance mandate on those blue states would just devastate Democrats. They would find their consolidated power would be gone because redrawn districts favour areas outside their power cities.
