In yet more good news for those wanting to see the Trump Administration do whatever it must to “drain the Swamp,” it appears that a federal investigatory body called the U.S. Office of Special Counsel is investigating former Special Counsel Jack Smith for his alleged violations of the Hatch Act.
Such is what Fox News Digital reported in an article on August 2, noting in its report, which relied on sources within the investigatory body, that the investigation stems from the former special counsel’s alleged involvement in partisan political activities while in his official capacity, though it is not a criminal investigation he is facing from the U.S. Office of Special Counsel (OSC).
Providing as much, Fox News Digital reported, “The U.S. Office of Special Counsel (OSC) is investigating former special counsel Jack Smith, the OSC has confirmed to Fox News.” The report went on to note that the OSC “is an independent federal investigative and prosecutorial agency,” that investigates alleged violations of four federal laws, most relevant of which here is the Hatch Act.
For reference, the Hatch Act restricts the types of political activities federal employees can engage in, generally forbidding them from engaging in partisan political activities, particularly when acting in an official capacity. The basis of the investigation into Smith appears to be a short series of claims released by Sen. Tom Cotton (R-AR) that Smith was using his special counsel position to benefit the Biden and Harris campaigns.
Beginning his litany of accusations against Smith, Sen. Cotton claimed, in a thread on X, “Jack Smith’s legal actions were nothing more than a tool for the Biden and Harris campaigns. This isn’t just unethical, it is very likely illegal campaign activity from a public office. Let’s take a look at just how egregiously Smith used his DOJ role to influence the election.”
Continuing, the senator explained, “Special Counsel Smith pushed for an out-of-the-ordinary, rushed trial for President Trump, with jury selection to begin just two weeks before the Iowa caucuses. No other case of this magnitude and complexity would come to trial this quickly.”
He added, commenting on how Smith tried to avoid normal channels so as to make the investigation worse for President Trump, “Special Counsel Smith tried to bypass the normal process and go right to the Supreme Court, but gave no reason why his abnormal request should be granted. The real reason was to get a quick ruling to damage Trump before the election—a partisan, unlawful action.”
Building on that, Sen. Cotton noted that Smith might have even broken the DOJ’s rules, saying, “Special Counsel Smith filed for a ‘procedurally irregular’ brief, with no defense motion pending, on September 24, 2024 which may violate DOJ’s 60-day rule before Election Day. This was breathlessly covered by the press in a way to damage Trump.”
The senator next noted that the various irregularities of the whole matter show that it was built around helping Kamala, stating, “This brief was 165 pages, four times greater than the normal maximum page limit, and included what was at the time secret grand jury testimony. Why? To help Kamala and hurt Trump. There is no other reason.”
Concluding the July 31 post, he called on the OSC to investigate Smith, saying, “These actions were not standard, necessary, or justified. They were the actions of a political actor masquerading as a public official. That’s why I’ve asked this unprecedented interference in the 2024 election be immediately investigated by OSC.”
