The Trump Administration Defends the Federal Ban on Interstate Handgun Sales

His administration, which is avowedly committed to protecting Second Amendment rights, nevertheless is defending that restriction against the FPC's challenge, saying it "serves legitimate objectives" and "only modestly burdens the right to keep and bear arms."

That argument sounds suspiciously like the sort of "interest balancing" that the Supreme Court emphatically rejected in Bruen. When a gun restriction affects conduct covered by "the Second Amendment's plain text," the Court said in that case, the government has the burden of demonstrating that it is "consistent with this Nation's historical tradition of firearm regulation." That test typically requires identifying historical analogs that are "relevantly similar" in motivation and scope to a challenged law.

The government's lawyers concede that the ban on interstate handgun sales "unquestionably burdens the fundamental right to keep and bear arms." But they argue that it "aligns with the nation's regulatory tradition," citing several historical precedents that the FPC describes as irrelevant or inadequate.

2020 proved they no longer need us. With a little help from the CCP, they can rig it any way they want it.

I can’t say I agree with the Trump Admin choice to restrict guns. “There are four boxes to be used in the defense of liberty: soap, ballot, jury, and cartridge (or ammo). Please use in that order.” The Biden administration silenced people, worked with the CCP to rig elections, used the legal system to attack political opponents......and we just barely escaped the the last box.

We need the last box to be there, because clearly the Democrats don’t respect the others.

I must have a typo in my copy of the bill of rights. The second amendment on mine ends saying “shall not be infringed.” I guess the official government copy says “shall only be moderately infringed.”
