Lawyers for Trump administration, California make their cases for who should control National Guard

A three-judge appeals panel heard arguments from lawyers Tuesday afternoon over the question of whether President Donald Trump can continue to control California’s National Guard as his administration carries out his deportation agenda, or if the troops should be returned to Gov. Gavin Newsom’s control.

U.S. District Judge Charles Breyer granted a restraining order last week, putting Newsom back in control of the Guard and calling Trump’s actions “illegal.”

But lawyers for the Trump administration appealed, and the 9th Circuit Court of Appeals temporarily blocked Breyer’s ruling, pending Tuesday’s hearing.

Brett Shumate, an attorney for the Trump administration, told the judges Tuesday that the National Guard is needed to protect federal buildings and agents in Los Angeles amid “ongoing violence.” Without the Guard, Shumate argued, properties and people would be at risk.

“The situation on the ground has not changed,” Shumate, an assistant attorney general in the Justice Department, said.

Shumate also argued that the courts do not have a role in reviewing Trump’s order federalizing the National Guard.

It’s the National Guard not the State Guard. They can fund their own guardsmen if they want to.

I would think he could just get Texas national Guard to go into LA. Might be more likely to obey him anyway. And not risk getting shot by one of the CA commies.

Again. Why is this in court? Are Trump’s lawyers this stupid? They give power to the judiciary where none exists.

Trump’s lawyers didn’t take it to court, Gov Hair-gel did. When you get sued you better respond, no matter how stupid the claim against you.

The governor is the head of each state’s National Guard, but the federal government can federalize them. Many units in war time started as National Guard units and then were federalized.

Eisenhower federalized the National Guard in Alabama and other states during the civil rights era also. President Trump is not doing something no one else ever has before.

Some Guard units are only for federal work, such as green beret units or units that are part of NATO American forces whose sole mission is European based, or Airborne units attached to the 82nd, etc.

They are all just National Guard units, the same as all National Guard units, there is a whole lot of variety of types of units in the National Guard and they all are there for the state and for call up to the federal.

When I said only for federal work I only meant that their mission is focused on that but not that they aren’t under the control of the governor, it is just that green beret units whose main area of operations are Southwest Asia and the Pacific are really focused on foreign missions and recent wars although for example some were called up for duty to protect the White House during the George Floyd riots and the governor might call them up for something.

The highly decorated 151st Airborne Ranger LRRP unit from Indiana serving in Vietnam made a lot of sense but their type mission would have little utility in Indiana, although the governor could activate them and might have for little state tasks, it would have detracted from their training and focus on foreign operations (that unit no longer exists).

Eisenhower Federalist the Arkansas National Guard AND sent federal troops to Little Rock.

Kennedy did it in Alabama and Mississippi.

Grant did it in South Carolina.

Washington did it too during the Whiskey Rebellion.

All but Washington did it to slap Dems around for their racism. Blocking black kids from going to school. In SC it was to go after the KKK.

That's an absolutely terrible idea. Most of us were just coming off two weeks of AT, ready to go home, but instead this boondoggle was a complete pain...
