Trump Scores BIG LEAGUE Win in Tariff Fight With the Courts

Two courts ruled against the tariff policy enacted by President Donald J. Trump. On Wednesday, the U.S. Court of International Trade ruled that Trump’s tariff policy was unlawful, blocking a central tenet of the president’s agenda on the economy and trade. The Liberation Day reciprocal tariffs led to scores of nations lining up to renegotiate their deals. We’ve already inked our new one with the United Kingdom. D.C. District Court Judge Rudolph Contreras also ruled earlier today that the tariff policy was illegal, though he stayed his decision for 14 days to allow for the appeals process.

Yet, before the anti-Trump clown could celebrate, a federal appeals court, the full 11-member panel, stayed the ruling from the Court of International Trade, allowing for the tariffs to remain in place for now—a significant win (via NY Post): 

A federal appeals court put the brakes Thursday on a lower court order that overturned most of President Trump’s sweeping tariffs. 

A full 11-judge panel on the US Court of Appeals for the federal circuit stayed the order by the Manhattan-based Court of International Trade while the White House appeal is heard.

The Court of International Trade had ruled that Trump exceeded his authority under the International Emergency Economic Powers Act by imposing a 10% flat duty rate on dozens of countries around the world — as well as 25% tariffs on Canada and 20% tariffs on China and Mexico in response to illegal fentanyl trafficking. 

The tariffs had been challenged by a dozen states and five small business — which the appeals panel gave until June 5 to respond to Thursday’s stay.

Regarding tariffs, first consider that we never hear about the federal government's constitutionally limited power anymore, the unconstitutionally big federal government now regularly taxing and spending for things that the states have never expressly authorized the feds to do.

Regarding Congress's power to regulate tariffs, it is important to understand that Thomas Jefferson had noted that the early constitutionally limited power Congresses were able to pay for the federal government to operate using only tariffs.

The rich alone use imported articles, and on these alone the whole taxes of the General Government are levied [emphasis added]. … Our revenues liberated by the discharge of the public debt, and its surplus applied to canals, roads, schools, etc., the farmer will see his government supported, his children educated, and the face of his country made a paradise by the contributions of the rich alone, without his being called on to spend a cent from his earnings.” —Thomas Jefferson to Thaddeus Kosciusko, 1811.

The main reason that unconstitutional, wasteful federal taxing and spending is now a major concern, thanks to PDJT47 and Mr. Musk, is this imo. Post-17th Amendment ratification (17A; popular voting for federal senators) crook politicians discovered that they could promise voters who have evidently never really studied the fed's constitutionally limited powers, every unconstitutional federal social-spending program under the sun to get themselves elected, voters ultimately taking the bait and electing them.

Then once in office, tax-hungry lawmakers fulfill their campaign promises by abusing their 16th Amendment power (direct taxes) to lay unconstitutional taxes to establish the likewise unconstitutional spending programs that they promised to clueless taxpayers on the campaign trail.

In other words, clueless voters who unthinkingly elect, and then reelect, their corrupt celebrity career lawmakers, lets call it insanity, also compare with drunk driving, have effectively aborted the constitutional republic.

In fact, consider that if patriots had had their voting act together, they could have theoretically replaced the entire Senate twice+ by now since Obama's first midterm elections.

The 16th Amendment is the pot of gold at the end of the rainbow for organized crime, that amendment also weakening our 4th Amendment protections imo, and desperately needs to be repealed along with 17A.

We'll call the repeal amendment Trump's Boston Tea Party II Amendment.

Once unconstitutional federal taxing and spend is stopped, the states will ultimately find a tsunami of new revenues that they probably won't know what to do with imo.

Funny there were no injunctions with Obama tariffs or Trump tariffs in his first term or Biden keeping them.

These injunctions are now the only tool the left has.

SCOTUS doesn’t care because CJ Roberts is a useless punk.

There were articles last week that the judges are calling for more security as the SCOTUS rulings coming up are making them feel unsafe.

The biased, unethical PBS put it this way:
As Trump lashes out against courts, calls grow for judges to control their security force.

NOTE THIS PHRASE IN THE ARTICLE:

What does the phrase “for now” mean?

That means moer uncertainty the way I see it.
