Federal judge temporarily blocks deportation of illegal Asian migrants to Libya

federal judge on Wednesday granted a temporary restraining order that blocks the Trump administration from deporting illegal Asian migrants to the African country of Libya, or any other third world country.

The move comes after lawyers filed an emergency motion earlier in the day, seeking to stop the deportations that were reportedly scheduled for sometime this week. The Trump administration has not formally commented on the plans.

The lawyers claimed that the migrants, who came from Laos, the Philippines and Vietnam, among other places, were expected to be loaded onto a U.S. military aircraft and transported to Libya, according to NBC News.

The court document, which was filed in the U.S District Court in Massachusetts, also said the migrants were being deported “without any reasonable fear screening, let alone a fifteen-day window to file a motion to reopen with the immigration court to contest any negative reasonable fear determination."

The development comes after Secretary of State Marco Rubio said last month that the administration was "actively searching for other countries" to send illegal migrants to.

“We are working with other countries to say, ‘We want to send you some of the most despicable human beings to your countries,’” Rubio said. “‘Will you do that as a favor to us?’ And the further away the better, so they can’t come back across the border.”

Libya has denied discussions with the U.S. about taking in migrants, and said it rejects the U.S. deporting migrants there without its knowledge or consent.

“The lawyers claimed that the migrants, who came from Laos, the Philippines and Vietnam”

Why are we not sending them to Laos, the Philippines and Vietnam?

Send them to Saudi Arabia, Yemen, Libya etc. They need the slave labor and would be welcomed there. Illegals are not welcome in the USA - not enough housing, tax dollars need to be spent on Americans.

No law gives a judge that authority. The alien enemy act specifically excludes judge’s authority.

Why not just send them back to where they left from?

That's not the point. This is more brilliant messaging by Trump to illegals in our country that "if you don't self-deport, you might end up in a Libyan prison" LOL

Brilliant.

“The alien enemy act specifically excludes judge’s authority.”

I do not believe that illegals from Laos, the Philippines and Vietnam are considered ‘enemy aliens’, Don’t know why they can’t be sent back ‘home’.

Until trump begins deporting the 1.4 million that have deportation orders from biden’s term, we are not doing it right.

Either their home countries are refusing to take them back or they are refusing to be sent back, making assylum claims. Finding a 3rd country willing to take them that they are willing to go to gets them gone faster and avoids their bogus due process claims.

Quote from the Convention Relating to the Status of Refugees:

Article 32. - Expulsion

1. The Contracting States shall not expel a refugee lawfully in their territory save on grounds of national security or public order.
2. The expulsion of such a refugee shall be only in pursuance of a decision reached in accordance with due process of law. Except where compelling reasons of national security otherwise require, the refugee shall be allowed to submit evidence to clear himself, and to appeal to and be represented for the purpose before competent authority or a person or persons specially designated by the competent authority.
3. The Contracting States shall allow such a refugee a reasonable period within which to seek legal admission into another country. The Contracting States reserve the right to apply during that period such internal measures as they may deem necessary.

What does Trump have to do to get the US out from under the Refugee Convention?

Send (or hand deliver) the Secretary-General of the United Nations Antonio Guterres a letter!

Dear Secretary-General of the United Nations:

I, Donald J. Trump, the President of the United States, on behalf of the United States, do denounce the 1951 Convention Relating to the Status of Refugees and its 1967 Protocol, as permitted by Article 44.

Donald J. Trump

"... deportations that were reportedly scheduled for sometime..."

Hmmm...
More leaking?

The administration inherited 200,000 pails, all full of holes...

Time to get really serious about stopping them...

Why not just send them back to where they left from?

I'm guessing those countries don't want them back.

Which brings rise to the problem with deportations. Some countries won't accept them back --- maybe because the illegal alien lied about his country of origin? Or maybe they are just evil violent criminals?

Anyway, what do you do then? Guantanamo? Alcatraz? Martha's Vineyard?

These judges need a good caning, by an expert from Hong Kong. Say, 100 strokes. As a warning to the rest.
