Justice Department sues Hawaii, Michigan over plans to sue fossil fuel companies for climate harm

DETROIT (AP) — The U.S. Justice Department on Wednesday filed lawsuits against Hawaii and Michigan over their planned legal action against fossil fuel companies for harms caused by climate change, claiming the state actions conflict with federal government authority and President Donald Trump’senergy dominance agenda.

The suits, which legal experts say are unprecedented, mark the latest of the Trump administration’s attacks on environmental work and raises concern over states’ abilities to retain the power to take climate action without federal opposition.

In court filings, the DOJ said the Clean Air Act — a federal law authorizing the Environmental Protection Agency to regulate air emissions — “creates a comprehensive program for regulating air pollution in the United States and “displaces” the ability of States to regulate greenhouse gas emissions beyond their borders.”

DOJ argues that Hawaii and Michigan are violating the intent of the Act that enables the EPA authority to set nationwide standards for greenhouse gases, citing the states’ pending litigation against oil and gas companies for alleged climate damage.

Democratic Michigan Attorney General Dana Nessel last year tapped private law firms to go after the fossil fuel industry for negatively affecting the state’s climate and environment.

Meanwhile, Democratic Hawaii Governor Josh Green plans to target fossil fuel companies that he said should take responsibility for their role in the state’s climate impacts, including 2023’s deadly Lahaina wildfire.

When burned, fossil fuels release emissions such as carbon dioxide that warm the planet.

Both states’ law claims “impermissibly regulate out-of-state greenhouse gas emissions and obstruct the Clean Air Act’s comprehensive federal-state framework and EPA’s regulatory discretion,” DOJ’s court filings said.

A couple of thoughts:

How can the producers be responsible but the users who burned their products aren’t?

How many more deaths would there have been if we didn’t have access to “fossil” fuels?

Exactly why the Tobacco Settlements were wrong and a very bad decision. If you drive a car, turn on lights in your house, use air conditioning, heating, computers, or phones, you should also be subject to liabilities for the harm you caused.

It’s worse than that. To even accept the premise that harm was caused by everyday normal activity and that said “harm” is caused by oil companies is going have disastrous effect. The SC had a chance to kill this BS in the crib a few months ago but no they let it go forward and now this crap is going to pop up like weeds in the rat states.

I want to see these states in court explain what harm has been done to the climate.

It would be like these protesters claiming Trump is a racist and liar, but when asked for an example they stammer and then get mad at the questioner.

If climate-change obeyed states’ borders and only harmed those states, then Hawaii and Michigan might have a case against the Trump administration.

But, the climate affects the whole world equally, which then makes it a federal issue and one which fall under the right of the federal government to regulate intestate trade/economic policy.

Interstate commerce falls under the jurisdiction of the federal government.

But, if the states in question want to pursue the cases, then they have to prove that climate change has done harm to the environment and with proof without a doubt. Climate change is hard to prove as harmful, especially since the climate has been changing since the planet was formed. The defenders of the states’ lawsuit would have to go back millions, perhaps billions of years to prove their case.

I wish these fossil fuel companies would just make an example of one or more of these states. If Hawaii wants to sue we don’t do business with Hawaii any longer. No oil, no gasoline , no aviation fuel and no petrochemicals.

See how long Hawaii can live with no gas and no tourists.

Michigan produces millions of vehicles yearly which use fossil-fuels, which according to democrats, cause great harm to the environment. Which would mean that Michigan should lose the car-manufacturing plants and move them out of state. I'm sure the people of Michigan would be opposed to losing what's left of their part of the car industry. Let Michigan try to produce only EVs, and see their economy tank.

If one can draw legal liabilities claims for harm in energy sectors, how does that square with future research and development projects in private industry for literally anything? Tupperware was facing "microplatics" litigation. Pharma is facing vaccines litigation. Beverage companies are facing harm litigation.

It becomes a disease in and of itself.
