I would like to embrace the severity of James’ sins, but I’m
not convinced on some of them.
Declaring your father as your husband is a big no-no. James
should be called to answer for that. It is unclear if it was
the father that declared the expanded relationship with his
daughter or whether Tish was a party to the lie. Either way,
it is illegal and undoubtedly creepy.
The 1991 code violation on the property she bought in 2001.
The fact that it is still open is a clerical question for
Building Department in Brooklyn, not for Tish James. So to
the discrepancy regarding the number of occupiable units.
Is it 0ne-two? Four? Five? There are people in the Inspections
Department who are tasked to determine that number. The
home owner may be an accessory, but the violation rests with
the public building officials.
Finally, the violation for the scaffolding is a total non-starter.
Unless she owns a scaffolding company on the side, I am pretty
sure that James hired a company to paint the exterior or
repoint the masonry, both of which might require a scaffold.
So the painter hires a scaffolding company to provide and
erect a scaffold so he can do his work. If improperly anchored,
the violation is with the scaffolding company, not the owner.
I have no problem seeing Tish James behind bars for the scams
she has run in her own real estate misadventures. But the
sins ascribed to her in the article don’t rise to anything
but a slap on the wrist.
