A U.S.-born American citizen was being detained at the request of immigration authorities Thursday despite an advocate showing his U.S. birth certificate in court and a county judge finding no reason for him to be considered an “illegal alien” who illegally entered Florida.
Juan Carlos Lopez-Gomez, 20, was arrested Thursday evening by Florida Highway Patrol and charged under a state immigration law that has been temporarily blocked since early this month. Details of Gomez-Lopez’s arrest and detention were first reported by the Florida Phoenix news site.
After inspecting his birth certificate, Leon County Judge LaShawn Riggans said during the hearing that “this is indeed an authentic document,” but that she did not have jurisdiction beyond finding no probable cause for the charge.

What’s not being reported is who was in the vehicle with him which may have a lot to do with why he was arrested.
All four of his names; first, middle and the two surnames, are very common for Hispanic males in the United States.
Mistaken identity is a possibility. Birth Cert. should have cleared that up.

Two other men who were in the car with Lopez-Gomez, the driver and another passenger, also had their first appearances on the same charges on Thursday. The driver was also charged with driving without a license.
The state trooper pulled over the car Lopez-Gomez was in because the driver was going 78 mph in a 65 mph zone, according to the arrest report. Lopez-Gomez gave his Georgia state ID to the trooper, who wrote in his report that Lopez-Gomez said he was in the country illegally.
No indication if he was just joking or the defense claiming the cop was lying.

US citizens are liable to arrest by immigration authorities for violating criminal immigration laws outlined in Title 18 US Code, including being a principal in visa fraud, marriage fraud, smuggling, human trafficking, assault on immigration officers, and others.

just because he was born in the US doesn’t necessarily mean he is here legally. Could have been born to illegals and not properly documented while a baby. Birth Certificates seem to be easy to get for many who should not have a US one.
