A federal appeals court rejected the Trump administration’s request that it halt the next steps Judge Paula Xinis is seeking to take in the case concerning a migrant who was wrongly deported to El Salvador, with a strident warning about the rule of law and the possibility the dispute presented an “incipient crisis.”
The 4th US Circuit Court of Appeals said in its seven-page ruling Thursday that the Trump administration’s assertions in the case “should be shocking not only to judges, but to the intuitive sense of liberty that Americans far removed from courthouses still hold dear.”
The unanimous ruling was written by Judge Harvie Wilkinson, an appointee of former President Ronald Reagan. In it, he was extremely critical of the administration’s effort to undo some of Xinis’ recent orders in the case, sounding alarm bells about how its maneuverings in the matter have resulted in the two branches “grinding irrevocably against one another in a conflict that promises to diminish both.”
“The Judiciary will lose much from the constant intimations of its illegitimacy, to which by dent of custom and detachment we can only sparingly reply,” Wilkinson wrote. “The Executive will lose much from a public perception of its lawlessness and all of its attendant contagions. The Executive may succeed for a time in weakening the courts, but over time history will script the tragic gap between what was and all that might have been, and law in time will sign its epitaph.”
The appeals court used the order to weigh in on the broader atmosphere around President Donald Trump’s conflict with the judiciary.

Trump is looking at the situation with the 1X Mark I Eyeball. But judges are surrounded by “LAWS” and those are in fine, fine print requiring 10X magnification or higher. What you can’t see at the higher magnification is the entire picture. Are these people Trump is throwing out good for the country or bad for the country? I think the judges are trapped in a forest so dense they can’t see the trees. Trump, far above them, can make out the trees just fine. It’s all a matter of perspective.
Just a question: say China (or any other country) sends soldiers over the border but they come dressed in civilian clothes. Some commit crimes like trespassing on sensitive military installations.
Intelligence links said people, finding the group is part of a foreign government or a terrorist organization.
Does every one of them get a court date to see if they can be removed?
Do you have to wait for an official declaration of war before acting on such a threat?

Judge? Or arrogant grandstanding drama queen?
We cannot expect the Judiciary to do anything but protect their own power.
I say this as a lawyer, something has to change. The 4th Circuit in this case duly notes that its legitimacy is at stake. That legitimacy is based on the goodwill of the other branches. The 4th Circuit also arrogantly claims that failure to allow its power grab will adversely affect the legitimacy of the Executive.
What they miss is that the legitimacy of the Executive and Congress is in the hands of the voters.
Scream about the “rule of law” all they want, but if at the end of the day the voters approve of what Trump is doing, the Judiciary has nothing. Then, it is they who would find that their too long tolerated hubris has destroyed their power.
WTH is this? The case has already been ruled on the at the SC. Trump has agreed to provide transport if El Salvador wants to send him back. That should be the end of it. The rats/MSM are dying to have the spectacle of the illegal getting off the plane on our soil. That will not have the effect they think it will.
Lawlessness?! What kind of BS ruling is this? None of these, so-called, judges lifted a finger when Biden refused to protect the border and let millions of illegals in and then gave them social security numbers and let them vote.
That’s your “lawlessness” plain and simple.
Trump is enforcing the laws, as written and the judges are flaunting that and forcing the executive office to act ILLEGALLY.
Checks and balances means the courts have to be checked as well.
