Idaho Gun Owner Found Not Guilty in Self-Defense Case

An Idaho gun owner from Kuna was found not guilty by a jury of his peers recently in a case that some are questioning why the gun owner was charged in the first place.

What’s Happening: Theron Cameron, a Blackhawk helicopter pilot who does search and rescue missions, a combat veteran, and former sheriff’s deputy, rushed to his child’s bus stop after his wife called, terrified. A man had attempted to kill himself and was threatening kids and Theron’s wife, according to testimony in court.

Theron eventually drew his weapon in a low-ready stance after the man was running at his wife’s car, which was stopped in the road. Theron got between the man and his wife’s car with his vehicle. It was only after the man kept moving toward his family that Theron drew his firearm in defense of himself and others.

Theron ended up on trial facing two felony assaults with a deadly weapon and a misdemeanor brandishing charge.

Digging Deeper: Theron is an outstanding citizen with no criminal record. He rushed as fast as he could to protect his family. He did what many fathers would have done and what many wives would have wanted their husbands to do.

The evidence does not indicate that Theron did anything wrong. The big question is, why did the prosecutors try this case in the first place?

State Senator Christy Zito (R-Mtn. Home) told Idaho Dispatch,

“I have followed the case from the very beginning. When you hear Theron’s story and look at all the evidence, there isn’t a person with any common sense who would have charged him with a crime. His family spent tens of thousands of dollars in a trial that should have never happened.”

The judge in the case instructed the jury, citing Idaho’s Stand Your Ground law and self-defense laws. In the end, the jury agreed and found Theron not guilty.

Because lawful gun ownership and use for protection is commonly perceived as guilty until proven innocent.

The prosecutor, NOT THE STATE, should be held personally liable for court cost and reimbursement.

STUPID should hurt.

100%. I should of been more clear. The prosecutor needs a trial followed by prison time for violation of rights.

why can’t prosecuters be personally sued for recovery of funds spent to defend against viciously unrightous prosecution and persecution of those Americans who are simply WILLING to do the right thing when the right thing needs doing? these prosecutors should be tarred, feathered and run out of town on a rail for making communities less safe by curbing those willing to do what needs to be done for fear of being prosecuted just for DOING the right thing.

The recourse is to sue the prosecutor for $10 million for wrongful prosecution and malicious politicalization.

I’m done with these tards. There needs to be a precedence set that will deter these activist prosecutors and judges from doing dumb things. Needs to be a severe deterrent.

Expenses can be reimbersed. And time away from job follows that. It falls under their Title 19:

TITLE 19
CRIMINAL PROCEDURE
CHAPTER 39
PROCEEDINGS IN MAGISTRATE’S DIVISION OF THE DISTRICT COURT
19-3924. Malicious prosecution — Judgment against prosecutor. If the prosecutor does not pay the costs, or give security therefor, the court may enter judgment against him for the amount thereof, which may be enforced in all respects, in the same manner as a judgment rendered in a civil action.

And yes, in Idaho, you can potentially sue for emotional distress, including personal embarrassment, if someone’s actions caused you severe emotional harm through outrageous or intentional conduct, even without physical injury. So it may take more time, but it can be recovered. Possible good part about this is that the state might just want to settle out of court with an offer just to keep it out of the papers. (Some my friends would talk to about how I was mistreated)

The law makes it purposely difficult to sue prosecutors and government officers. One reason: If they are easily susceptible to civil suit, it would greatly discourage people from working in those positions.

I understand the DA makes the decision whether to pursue charges or not. The prosecutor does what DA the tells him to.

At this point, Theron turned and told the woman to back up, give him space, and get away from the situation. It was this woman who alleged that Theron also pointed his firearm at her.

The woman and her sister both testified that a red or green dot was pointed at her chest. The only issue with their testimonies was that the weapon did not have a laser, and even the prosecution's witness, an Ada County deputy, testified that no laser could be found on the gun. So, why were both of them testifying about a laser dot on the woman's chest?

A defense witness testified that Theron only pointed his gun at the man who was coming toward his wife and children. He testified that Theron never pointed the gun at the woman. However, police arrived later on and arrested Theron for aggravated assault with a deadly weapon.
