ICE admits to an 'administrative error' after Maryland man sent to El Salvador prison

A Maryland man with protected legal status was sent to the notorious prison in El Salvador following an "administrative error," a U.S. Immigration and Customs Enforcement (ICE) official admitted in a sworn declaration on Monday.

Kilmer Armado Abrego-Garcia who has a U.S. citizen wife and 5-year-old child is currently at CECOT, the notorious prison in El Salvador.

The filing is part of a new lawsuit filed by Abrego-Garcia's attorneys who are requesting that the government of El Salvador return him to the U.S. after being sent there "because of an administrative error."

In response, the government has acknowledged the error but said in a filing that because Abrego-Garcia is no longer in U.S. custody, the court cannot order him to be returned to the U.S. nor can the court order El Salvador to return him.

He’s still an illegal so eff him. Homan warned them about collateral damage for not cooperating with ICE. If he gets out of prison he should not be brought back here.

That's my thinking as well. If you weren't born here or didn't go through legal immigration you shouldn't feel safe to remain here.

No sympathy. His lawyers are trying to argue there was no official evidence (in America) he was a gang member. meaning it was not presented and tried in court here, basically lying with the law, horrible people.

There's some question as to whether he was convicted of this or not, but there's no question he's illegal.

According to Abrego-Garcia's attorneys, in 2019, a confidential informant "had advised that Abrego Garcia was an active member" of the gang MS-13. He later filed an I-589 application for asylum and although Abrego Garcia was found removable, an immigration judge "granted him withholding of removal to El Salvador."

This one case will be enough for SCOTUS to side with the lower courts that full due process must be followed before any deportations can commence.

The whole "better 1,000 guilty go free than one innocent be imprisoned" thing, even if this guy is an admitted MS-13 member. Judges, even ones like Justice Thomas, tend to stick together when it comes to enforcing their rulings.

According to the article, not an illegal.

This is why constitutional conservatives revere the constitutional requirement for due process.

But due process can vary with the context. An administrative hearing can function with the burden on the one to be deported, with no or very limited rights of appeal and without screwball leftists whispering how to claim amnesty into his ear in Spanish, can still be proper due process.

If we have up to 20 million to deport, we have to have limited due process with the emphasis on the word "limited"

There is always a question when you only accept the defense lawyer / democrat point of view.. The issue is supposedly he had protected status form Biden, the is the administrative error, not the question of his affiliation with MS-13 they are trying to get deceive you with. The error being claimed was not his status as an MS-13 member or illegal alien, it is the fact he had protected status from Biden.

All distractions to deceive people.

Vice President JD Vance said in a statement on X that Abrego-Garcia was a “convicted MS-13 gang member with no legal right” to be in the U.S. Vance added that “it’s gross to get fired up about gang members getting deported while ignoring citizens they victimize.”

Yes, lovely idea, require all 40-60 million illegal, many criminal aliens to have full court immigration hearing. Nice to know you do not recognize the separation of powers and believe the judicial system reigns supreme. Apparently all constitutional powers must first be authorized by a court before an executive as any authority?

Sometime around the year 6000 AD the courts may finally adjudicate the final immigration case. How exactly does a country run if there is literally no way to implement the law efficaciously?

The law under such a premise invalidates itself and no longer serves humanity but serves itself, this is how civil war and insurrections get created. Utter insanity.

I haven’t read the whole article, but does the entire case against him depend solely on one confidential informant?

That’s a bit of a scary thought. The CI is probably an u savory character, maybe a gang member turned by law enforcement. Do CIs have quotas to stay in good standing with their handlers? Does this CI have a grudge against the guy? Is the CI trying to ingratiate himself to his handler?

I want all the scum out of our country as much as anyone, but these are genuine concerns.

Maybe the DOJ should set up a special fast-acting court to adjudicate these case and heavily staff it. Kind of like the FISA Court. But where do you find non bleeding heart conservative judges?

No, he also is marked and anyone who thinks getting a real gang tattoo is not relevant is totally ignorant of the culture.

He hung in circles where gang members frequent, one does not wear colors or markings without being a member or one gets killed, period.

This guy convicted himself just with his marking alone and affiliations.

"Abrego-Garcia, a native and citizen of El Salvador, was on the third flight and thus had his removal order to El Salvador executed," said Robert L. Cerna, acting field office director for ICE in a sworn declaration. "This removal was an error."

"This was an oversight, and the removal was carried out in good faith based on the existence of a final order of removal and Abrego-Garcia's purported membership in MS-13," Cerna said.

Also, he was seen wearing a Jordan "Jumpman" shirt, which has been flagged as having gang affiliations.

Ya I read that, it doe snot state specifics about the error or nature of his deportation. I do not see where your quote adds any clarification.

Feel free to propound upon what the “error” actually was.
